{"id":11803,"date":"2020-05-05T10:00:30","date_gmt":"2020-05-05T10:00:30","guid":{"rendered":"https:\/\/shp.al\/a-jane-ndryshimet-e-fundit-ne-kodin-penal-masat-e-duhura-ne-parandalimin-e-perhapjes-se-covid-19\/"},"modified":"2020-11-03T11:14:41","modified_gmt":"2020-11-03T11:14:41","slug":"a-jane-ndryshimet-e-fundit-ne-kodin-penal-masat-e-duhura-ne-parandalimin-e-perhapjes-se-covid-19","status":"publish","type":"post","link":"https:\/\/shp.al\/sq\/a-jane-ndryshimet-e-fundit-ne-kodin-penal-masat-e-duhura-ne-parandalimin-e-perhapjes-se-covid-19\/","title":{"rendered":"A jan\u00eb ndryshimet e fundit n\u00eb Kodin Penal masat e duhura n\u00eb parandalimin e p\u00ebrhapjes s\u00eb Covid-19?"},"content":{"rendered":"<p style=\"text-align: right;\"><strong> Nga:<br \/>\nAvokat Isuf Shehu,<br \/>\nAvokat Oltion Vathaj<\/strong><\/p>\n<p style=\"text-align: justify;\"><strong>N\u00eb seanc\u00ebn e dat\u00ebs 16.04.2020, Kuvendi, ka miratuar<\/strong> projektligjin \u201cP\u00ebr disa shtesa dhe ndryshime n\u00eb ligjin Nr. 7895, dat\u00eb 27.1.1995 \u201cKodi Penal i Republik\u00ebs s\u00eb Shqip\u00ebris\u00eb\u201d, i ndryshuar\u201d, n\u00eb kuad\u00ebr t\u00eb masave parandaluese kund\u00ebr pandemis\u00eb Covid-19, ku konkretisht jan\u00eb shtuar k\u00ebto dispozita ligjore:<\/p>\n<p style=\"text-align: justify;\"><strong>Neni 89\/b i Kodit Penal<em> P\u00ebrhapja e s\u00ebmundjeve infektive<\/em><\/strong><\/p>\n<p style=\"text-align: justify;\"><em>P\u00ebrhapja me dashje e s\u00ebmundjes infektive me rrezikshm\u00ebri t\u00eb lart\u00eb p\u00ebr sh\u00ebndetin, n\u00ebp\u00ebrmjet kryerjes s\u00eb veprimeve apo mosveprimeve nga personi q\u00eb \u00ebsht\u00eb diagnostikuar si mbart\u00ebs i s\u00ebmundjes apo nga personi q\u00eb ka q\u00ebllim p\u00ebrhapjen e saj, d\u00ebnohet me burgim nga 2 (dy) deri n\u00eb 5 (pes\u00eb) vjet.<br \/>\nKur kjo vep\u00ebr \u00ebsht\u00eb kryer nga pakujdesia d\u00ebnohet me gjob\u00eb ose burgim deri n\u00eb 2 (dy) vjet.<\/em><\/p>\n<p style=\"text-align: justify;\"><em>Po kjo vep\u00ebr, kur ka shkaktuar pasoja t\u00eb r\u00ebnda p\u00ebr sh\u00ebndetin ose \u00ebsht\u00eb rrezikshme p\u00ebr jet\u00ebn e njer\u00ebzve, d\u00ebnohet me burgim nga 3 (tre) deri n\u00eb 8 (tet\u00eb) vjet.<\/em><\/p>\n<p style=\"text-align: justify;\"><strong>Neni 242\/1 i Kodit Penal<em> Moszbatimi i masave t\u00eb autoriteteve shtet\u00ebrore gjat\u00eb gjendjes s\u00eb masave t\u00eb jasht\u00ebzakonshme apo gjat\u00eb gjendjes s\u00eb epidemis\u00eb<\/em><\/strong><\/p>\n<p style=\"text-align: justify;\"><em>Moszbatimi ose kryerja e veprimeve n\u00eb kund\u00ebrshtim me aktet ligjore apo n\u00ebnligjore t\u00eb nxjerra nga organet shtet\u00ebrore, n\u00eb funksion t\u00eb gjendjes s\u00eb epidemis\u00eb apo t\u00eb zbatimit t\u00eb masave t\u00eb jasht\u00ebzakonshme, nga personi ndaj t\u00eb cilit \u00ebsht\u00eb dh\u00ebn\u00eb m\u00eb par\u00eb mas\u00eb administrative, p\u00ebrb\u00ebn kund\u00ebrvajtje penale dhe d\u00ebnohet me gjob\u00eb ose me burgim deri n\u00eb 6 (gjasht\u00eb) muaj.<\/em><\/p>\n<p style=\"text-align: justify;\"><em>Po kjo vep\u00ebr, kur \u00ebsht\u00eb kryer n\u00eb ushtrim t\u00eb aktivitetit tregtar, duke vendosur n\u00eb rrezik sh\u00ebndetin e njer\u00ebzve, d\u00ebnohet me gjob\u00eb ose me burgim deri n\u00eb 2 (dy) vit.<\/em><\/p>\n<p style=\"text-align: justify;\"><em>Moszbatimi i urdhrit t\u00eb dh\u00ebn\u00eb nga organet kompetente p\u00ebr karantinimin ose izolimin apo shkelja e rregullave t\u00eb karantin\u00ebs ose t\u00eb izolimit, nga personi mbart\u00ebs ose jo i s\u00ebmundjes infektive, t\u00eb cilit i \u00ebsht\u00eb njoftuar ky detyrim nga autoritetet shtet\u00ebrore p\u00ebrkat\u00ebse, d\u00ebnohet me burgim nga 2 (dy) deri n\u00eb 3 (tre) vjet.<\/em><\/p>\n<p style=\"text-align: justify;\">K\u00ebto ndryshime t\u00eb sip\u00ebrcituara, parashikojn\u00eb sanksione penale ndaj disa formave t\u00eb mosbindjes s\u00eb qytetar\u00ebve, ndaj masave t\u00eb organeve kompetente shtet\u00ebrore gjat\u00eb gjendjes s\u00eb jasht\u00ebzakonshme ose gjendjes s\u00eb fatkeq\u00ebsis\u00eb natyrore (neni 242\/1), si dhe rregullave t\u00eb karantin\u00ebs, p\u00ebr parandalimin e p\u00ebrhapjes s\u00eb s\u00ebmundjeve infektive (neni 242\/2).<\/p>\n<p style=\"text-align: justify;\">Po le t\u00eb ndalemi fillimisht tek neni 89\/b dhe vecan\u00ebrisht tek elementet e vepr\u00ebs penale(krimit), dhe m\u00eb pas tek masa e d\u00ebnimit.<\/p>\n<p style=\"text-align: justify;\">N\u00eb paragrafin e par\u00eb t\u00eb k\u00ebtij neni \u00ebsht\u00eb p\u00ebrdorur tog\u00ebfjal\u00ebshi \u201c<strong><em>p\u00ebrhapja me dashje e s\u00ebmundjes infektive me rrezikshm\u00ebri t\u00eb lart\u00eb p\u00ebr sh\u00ebndetin<\/em><\/strong><em>\u201d. <\/em>K\u00ebtu vecojm\u00eb fjal\u00ebn <em>dashje<\/em>.<em> \u00a0<\/em>Sipas Kodit Penal<em> dashja<\/em> \u00ebsht\u00eb nj\u00eb nga format e fajit e parashikuar n\u00eb nenin 14 t\u00eb tij. Nuk do t\u00eb hyjm\u00eb n\u00eb thell\u00ebsi t\u00eb k\u00ebtij instituti t\u00eb r\u00ebnd\u00ebsish\u00ebm t\u00eb t\u00eb drejt\u00ebs penale duke e analizuar fjal\u00eb p\u00ebr fjal\u00eb dhe plot\u00ebsisht kuptimin e dashjes dhe format e saj por do t\u00eb mjaftohemi me p\u00ebrcaktimin e sakt\u00eb dhe lakonik t\u00eb nenit 15 t\u00eb Kodit Penal: \u201c<em>Vepra penale kryhet me dashje, kur personi i <\/em><strong><em>parashikon<\/em><\/strong><em> pasojat<\/em><em> e vepr\u00ebs penale dhe <strong>d\u00ebshiron<\/strong> ardhjen e tyre ose, megjith\u00ebse i <strong>parashikon<\/strong> dhe nuk i <strong>d\u00ebshiron<\/strong> ato, me <strong>nd\u00ebrgjegje<\/strong> lejon ardhjen e tyre.\u201d <\/em>K\u00ebtu shihen tre elemente: (i) parashikimi, subjekti i vepr\u00ebs penale e kupton r\u00ebnd\u00ebsin\u00eb e veprimeve q\u00eb \u00ebsht\u00eb duke b\u00ebr\u00eb, pra personi abstragon mbi nj\u00eb rezultat t\u00eb mundsh\u00ebm; (ii) d\u00ebshira, \u00ebsht\u00eb produkt sa i logjik\u00ebs por edhe e emocioneve t\u00eb subjektit t\u00eb vepr\u00ebs penale, me an\u00eb t\u00eb cilit tregon miratimin e ardhjes s\u00eb pasojave t\u00eb rrezikshme kriminale;\u00a0 dhe (iii) nd\u00ebrgjegja, n\u00eb fjal\u00eb m\u00eb t\u00eb thjeshta \u00ebsht\u00eb procesi t\u00eb kuptuarit dhe t\u00eb vler\u00ebsuarit nga ana e subjektit t\u00eb vepr\u00ebs penale t\u00eb mendimeve, d\u00ebshirave, q\u00ebllimeve, motiveve dhe veprimeve t\u00eb veta, n\u00eb t\u00ebr\u00ebsi. Duke u rikthyer tek vepra penale objekt analize, n\u00eb interpretim t\u00eb neniet 15 t\u00eb Kodit Penal, q\u00eb t\u00eb kemi dashje duhet q\u00eb autori i vepr\u00ebs penale t\u00eb parashikoj\u00eb faktin q\u00eb nj\u00ebr\u00ebzit mund t\u00eb vdesin apo t\u2019u d\u00ebmtohet sh\u00ebndeti, gjithashtu ai d\u00ebshiron q\u00eb kjo gj\u00eb t\u00eb ndodh\u00eb dhe t\u00eb gjitha k\u00ebto veprime ai i kryhen duke q\u00ebn\u00eb plot\u00ebsisht i nd\u00ebrgjegjsh\u00ebm. M\u00eb tej neni 89\/b i Kodit Penal vijon: \u201d<strong><em>n\u00ebp\u00ebrmjet kryerjes s\u00eb veprimeve apo mosveprimeve<\/em><\/strong>\u201d. Veprimet apo mosveprimet, jan\u00eb element\u00eb t\u00eb <em>an\u00ebs objektive<\/em> t\u00eb vepr\u00ebs penale dhe mund t\u00eb j\u00ebn\u00eb t\u00eb ndrysh\u00ebm dhe t\u00eb larmish\u00ebm, por n\u00eb thelb t\u00eb gjitha kan\u00eb p\u00ebr q\u00ebllim transmetimin apo futjen n\u00eb organizmin e gjall\u00eb t\u00eb agjentit patogjen q\u00eb shkakton s\u00ebmundjen. N\u00eb var\u00ebsi t\u00eb agjentit patogjen(virus, bakter apo ndonj\u00eb organiz\u00ebm tjet\u00ebr i natyr\u00ebs parazitare) kusht\u00ebzohet edhe m\u00ebnyra e infektimit por n\u00eb cdo rast ato jan\u00eb t\u00eb p\u00ebrcaktuara, identifikuara, t\u00eb aprovuara dhe t\u00eb p\u00ebrfshira n\u00eb protokollet mjek\u00ebsore. Duke e lidhur me situat\u00ebn konkrete at\u00eb t\u00eb pandemis\u00eb Covid-19 me t\u00eb drejt\u00eb lind pyetja a ka protokolle, rregullore dhe udh\u00ebzues q\u00eb p\u00ebrcaktojn\u00eb ekzakt\u00ebsisht menyr\u00ebn e trasmetimit dhe futjes s\u00eb k\u00ebtij virusi n\u00eb organiz\u00ebm q\u00eb m\u00eb pas t\u00eb mund t\u00eb p\u00ebrcaktojm\u00eb t\u00ebr\u00ebsin\u00eb e veprimeve dhe mosveprimeve q\u00eb jan\u00eb t\u00eb ndaluara dhe q\u00eb shkatojn\u00eb p\u00ebrhapjen e virusit Covid-19? Duhet pasur parasysh q\u00eb p\u00ebr Covid-19 \u00a0dihet shum\u00eb pak, q\u00eb \u00ebsht\u00eb ende n\u00eb faz\u00eb studimi dhe, q\u00eb deri tani studiuesit kan\u00eb dh\u00ebn\u00eb vet\u00ebm rekomandime dhe sygjerime. N\u00eb k\u00ebt\u00eb rast, pra kur patogjeni dhe vet\u00eb s\u00ebmundja ka shum\u00eb t\u00eb panjohura \u00ebsht\u00eb shum\u00eb e v\u00ebshtir\u00eb q\u00eb t\u00eb p\u00ebrcaktohet ekzakt\u00ebsisht se cilat jan\u00eb veprimet apo mosveprimet shoq\u00ebrisht t\u00eb rrezikshme n\u00ebp\u00ebrmjet t\u00eb cil\u00ebve p\u00ebrhapet infeksioni. E th\u00ebn\u00eb thjesht\u00eb, n\u00eb praktik\u00eb paraqiten v\u00ebshtir\u00ebsi n\u00eb provueshm\u00ebrin\u00eb e an\u00ebs objektive t\u00eb vepr\u00ebs penale, <em>actus reus<\/em>.<\/p>\n<p style=\"text-align: justify;\">Nj\u00eb problem tjet\u00ebr shquajm\u00eb tek cil\u00ebsit\u00eb e subjektit t\u00eb vepr\u00ebs penale t\u00eb nenit 89\/b t\u00eb kodit penal \u201c(i)<em>personi q\u00eb \u00ebsht\u00eb diagnostikuar si mbart\u00ebs i s\u00ebmundjes apo nga (ii)personi q\u00eb ka q\u00ebllim p\u00ebrhapjen e saj\u201d<\/em>, q\u00eb \u00ebsht\u00eb subejkt i posac\u00ebm por edhe i p\u00ebrgjithsh\u00ebm.<\/p>\n<p style=\"text-align: justify;\">Subjekti i posac\u00ebm \u00ebsht\u00eb (i) <em>Personi q\u00eb \u00ebsht\u00eb diagnostikuar si mbart\u00ebs i s\u00ebmundjes<\/em>, dhe k\u00ebt\u00eb cil\u00ebsi e merr mbi baz\u00ebn e nj\u00eb ekzaminimi mjeksor t\u00eb specializuar. Pavar\u00ebsisht se dispozita p\u00ebrcakton q\u00eb pergjegjesia penale lind me diagnostikimin e s\u00ebmundjes infektive, kjo nuk mjafton, pasi personi nuk \u00ebsht\u00eb ne dijeni t\u00eb rrezikshm\u00ebris\u00eb s\u00eb veprimeve apo mosveprimeve t\u00eb veta, pra duhet me doemos q\u00eb atij ti jet\u00eb komunimuar r\u00ebnd\u00ebsia e s\u00ebmundjes, m\u00ebnyra e nd\u00ebrveprimit me personat e tjer\u00eb, si dhe sjellja e tij n\u00eb t\u00ebr\u00ebsi duke p\u00ebrcaktuar m\u00ebnyr\u00ebn e izolimit dhe distancimit fizk. Subjekti p\u00ebrgjithsh\u00ebm \u00ebsht\u00eb <em>(ii)personi q\u00eb ka q\u00ebllim p\u00ebrhapjen e saj\u201d <\/em>i cili jo domosdoshm\u00ebrisht duhet t\u00eb jet\u00eb mbart\u00ebs, apo i diagnostikuar. Subjekti i p\u00ebrgjithsh\u00ebm merret n\u00eb pergjegj\u00ebsi penale kur ekziston dyshimi i arsyesh\u00ebm q\u00eb ai ka pasur si q\u00ebllim p\u00ebrhapjen e nj\u00eb s\u00ebmundje infektive. N\u00ebse n\u00eb rastin e subjektit t\u00eb posac\u00ebm personi instrumentalizon veten p\u00ebr t\u00eb p\u00ebrhapur s\u00ebmundjen(por edhe kjo gj\u00eb nuk \u00ebsht\u00eb kategorike), subjekti i p\u00ebrgjithsh\u00ebm n\u00ebp\u00ebrmjet mjeteve, m\u00ebnyrave, veprimeve apo mosveprimeve t\u00eb cilat mund t\u00eb jen\u00eb t\u00eb shum\u00ebllojshme p\u00ebrmbush q\u00ebllimin p\u00ebr t\u00eb p\u00ebrhapur s\u00ebmundjen infektive tek njer\u00ebzit e tjer\u00eb. Por n\u00eb t\u00eb dyja rastet pavar\u00ebsisht faktit n\u00ebse personi \u00ebsht\u00eb apo jo mbart\u00ebs, subjekti i vepr\u00ebs penale ka p\u00ebr q\u00ebllim p\u00ebrhapjen e s\u00ebmundjes infektive duke instrumentalizuar n\u00eb m\u00ebnyra nga me t\u00eb ndryshmet agjentin patogjen q\u00eb e shkakton at\u00eb. Por cdo t\u00eb thot\u00eb t\u00eb instrumentalizosh nj\u00eb agjent patogjen? Asgje m\u00eb shum\u00eb se, ta p\u00ebrdor\u00ebsh nj\u00eb nj\u00eb struktor\u00eb \u00a0biologjike mikroskopike si nj\u00eb arm\u00eb p\u00ebr t\u00eb shkatuar d\u00ebmtime t\u00eb sh\u00ebndetit apo vdekjen e nj\u00ebr\u00ebzve.<\/p>\n<p style=\"text-align: justify;\">Nga analiza n\u00eb t\u00ebr\u00ebsi e dispozit\u00ebs por duke marr\u00eb p\u00ebr baz\u00eb edhe shpjegimin q\u00eb u kemi dh\u00ebn\u00eb element\u00ebve t\u00eb saj kuptotohet fare qart\u00eb se ka nj\u00eb dallim t\u00eb madh midis q\u00ebllimi t\u00eb legjislatorit se p\u00ebrse ky i fundit ka parashikuar futjen e nj\u00eb dispozite t\u00eb till\u00eb n\u00eb Kodin p\u00ebr futjen n\u00eb kodin penal t\u00eb nj\u00eb dispozite t\u00eb till\u00eb ka q\u00ebne mbrotja e popullat\u00ebs dhe parandalimi i p\u00ebrhapjes s\u00eb s\u00ebmundjeve infektive gje e cila form\u00ebzon at\u00eb q\u00eb quhet objekt i vepres penale. Q\u00ebllimi i v\u00ebrtet\u00eb i subjektit t\u00eb vepr\u00ebs penale nuk \u00ebsht\u00eb p\u00ebrhapja e s\u00ebmundjes infektive por d\u00ebmtimi i sh\u00ebndetit dhe jet\u00ebs s\u00eb njer\u00ebzve. Le t\u00eb b\u00ebjm\u00eb nj\u00eb analogji p\u00ebr t\u00eb kuptuar m\u00eb mir\u00eb diferenc\u00ebn. N\u00ebs\u00eb nj\u00eb person mban nj\u00eb arm\u00eb zjarri pa lejen e organeve kompetente, ai \u00ebsht\u00eb subjekt i vepr\u00ebs penale t\u00eb <em>\u201c<\/em><em>Mbajtjes pa leje dhe prodhimi i arm\u00ebve, arm\u00ebve shp\u00ebrthyese dhe i municionit\u201d <\/em>parashikuar n\u00eb nenin 278 t\u00eb Kodit Penal, por n\u00ebse po i nj\u00ebjti person e p\u00ebrdor k\u00ebt\u00eb arm\u00eb p\u00ebr t\u00eb marr\u00eb jet\u00ebn e nj\u00eb ose shum\u00eb personave ai nuk akuzohet p\u00ebr \u201carm\u00ebmbatje pa leje me pasoj\u00eb vdekjen\u201d( vep\u00ebr penale q\u00eb nuk ekziston) por p\u00ebr vepr\u00ebn peanle t\u00eb vrasjes me dashje, vrasjes me paramendim, vrasje ne rrethana cil\u00ebsuese etj. \u00a0E njejta gje vlen edhe kur nj\u00eb p\u00ebrson p\u00ebrdor nj\u00eb agjent patogjen si arm\u00eb, e cila nuk \u00ebsht\u00eb nj\u00eb arm\u00eb t\u00eb zakonshme, por nj\u00eb arm\u00eb bio-kimike, dhe infekton nje azil t\u00eb moshuarish, nj\u00eb shkoll\u00eb, nj\u00eb lagje, nj\u00eb qytet apo nj\u00eb shtet t\u00eb t\u00ebr\u00eb ai nuk mund t\u00eb procedohet penalisht p\u00ebr vepr\u00ebn penale t\u00eb \u201cP\u00ebrhapjes s\u00eb s\u00ebmundjeve infektive\u201d, por p\u00ebr vrasje dhe jo nj\u00eb vrasje e zakonshme por \u201cvrasje ne mas\u00eb\u201d.<\/p>\n<p style=\"text-align: justify;\">Propozimi p\u00ebr futjen e nj\u00eb neni t\u00eb till\u00eb n\u00eb Kodin Penal, \u00ebsht\u00eb par\u00eb gjer\u00ebsisht si nj\u00eb ashp\u00ebrsim i politik\u00ebs penale me q\u00ebllim parandalimin e p\u00ebrhapjes s\u00eb s\u00ebmundjeve infektive por n\u00eb t\u00eb v\u00ebrtet\u00eb \u00ebsht\u00eb krejt e kund\u00ebrta. \u00cbsht\u00eb nj\u00eb iluzion t\u00eb mendosh q\u00eb Kuvendi ka ashp\u00ebrsuar masat kund\u00ebr p\u00ebrhapjes s\u00eb s\u00ebmundjeve infektive. Neni 89\/b \u00ebsht\u00eb nj\u00eb shembull i past\u00ebr i ndryshimeve ligjore q\u00eb b\u00ebhen n\u00eb ngutje e sip\u00ebr dhe si reaksion i situat\u00ebs s\u00eb emergjenc\u00ebs.<\/p>\n<p style=\"text-align: justify;\">Krejt ndryshe \u00ebsht\u00eb situata me p\u00ebrfshirjen n\u00eb Kodin Penal t\u00eb vepr\u00ebs penale t\u00eb <em>\u201c<\/em><em>Moszbatimit t\u00eb masave t\u00eb autoriteteve shtet\u00ebrore gjat\u00eb gjendjes s\u00eb masave t\u00eb jasht\u00ebzakonshme apo gjat\u00eb gjendjes s\u00eb epidemis\u00eb\u201d neni 242\/1.<\/em> Denimet e parashikuara n\u00eb k\u00ebt\u00eb dispozit\u00eb jan\u00eb t\u00eb ashpra dhe joporpocionale,\u00a0n\u00eb munges\u00eb t\u00eb nj\u00eb raporti t\u00eb drejt\u00eb midis rrezikshm\u00ebris\u00eb s\u00eb vepr\u00ebs penale apo kundravajtjes dhe\u00a0shkall\u00ebs s\u00eb faj\u00ebsis\u00eb s\u00eb autorit.<\/p>\n<p style=\"text-align: justify;\">Kjo dispozit\u00eb \u00ebsht\u00eb nj\u00eb sh\u00ebmbull i represionit dhe cenon parimin e humanizmit n\u00eb kushtet e k\u00ebsaj krize humanitare t\u00eb paprecedent\u00eb. NJ\u00eb parashikim i till\u00eb \u00ebsht\u00eb n\u00eb kund\u00ebrshtim me Kushtetut\u00ebn e Republik\u00ebs s\u00eb Shqip\u00ebris\u00eb dhe me standartet nd\u00ebrkomb\u00ebtare t\u00eb cilat lejojn\u00eb kufizimet e t\u00eb drejtave t\u00eb njeriut n\u00eb kushtet kur jeta dhe sh\u00ebndeti i njer\u00ebzve vihet n\u00eb rrezik, n\u00eb kuad\u00ebr t\u00eb masave parandaluese, ku cdo kufizim duhet t\u00eb jet\u00eb proporcional, n\u00eb p\u00ebrputhje me gjendjen q\u00eb e ka diktuar dhe t\u00eb mos cenoj\u00eb thelbin e lirive dhe t\u00eb drejtave t\u00eb njeriut. P\u00ebrderisa n\u00eb Shqip\u00ebri, nuk ka sh\u00ebmbuj t\u00eb mosbindjes civile dhe kur statistikat jan\u00eb relativisht t\u00eb ul\u00ebta t\u00eb p\u00ebrhapjes s\u00eb virusit Covid-19, ky ndryshim n\u00eb Kodin Penal nuk ishte i nevojsh\u00ebm dhe i p\u00ebrshtatsh\u00ebm dhe as i justifikuar. Masat e karakterit administrativ si gjoba p\u00ebr k\u00ebmb\u00ebsor\u00ebt, gjoba dhe pezullim t\u00eb lejedrejtimit t\u00eb drejtueve t\u00eb automjeteve te cil\u00ebt nuk rrespektojn\u00eb fashat orare t\u00eb l\u00ebvizjes, t\u00eb miratuar nga autoritetet shtet\u00ebrore, jan\u00eb masat adekuate parandaluese t\u00eb cil\u00ebt imponojn\u00eb nj\u00eb form\u00eb &#8220;presioni&#8221; n\u00eb m\u00ebnyr\u00eb indirekte, dhe q\u00eb sh\u00ebrbejn\u00eb p\u00ebr nd\u00ebrgj\u00ebgj\u00ebsimin e qytetar\u00ebve q\u00eb t\u00eb respektojne me rigorozitet masat parandaluese t\u00eb vendosura nga autoritetet shteterore kund\u00ebr pandemis\u00eb Covid-19.<\/p>\n<p style=\"text-align: justify;\">Miratimi i ndryshimeve ligjore n\u00eb Kodin Penal, p\u00ebr parashikimin e d\u00ebnimeve me burgim n\u00eb rast t\u00eb mosbindjes ndaj autoriteteve apo shkeljes s\u00eb rregullave t\u00eb karantin\u00ebs, \u00ebsht\u00eb kontradiktor dhe vjen n\u00eb kund\u00ebrshtim me politik\u00ebn penale t\u00eb ndjekur nga K\u00ebshilli i Ministrave n\u00ebp\u00ebrmjet miratimit t\u00eb Aktit Normativ Nr.7, dat\u00eb 23.3.2020 \u201c<em>P\u00ebr q\u00ebndrimin e p\u00ebrkohsh\u00ebm n\u00eb sht\u00ebpi t\u00eb t\u00eb d\u00ebnuarve<\/em>\u201d.\u00a0Ky akt kishte p\u00ebr q\u00ebllim marrjen e masave t\u00eb p\u00ebrkohshme p\u00ebr t\u00eb parandaluar p\u00ebrhapjen e infeksionit n\u00eb sistemin e ekzekutimit t\u00eb vendimeve penale duke garantuar kushtet p\u00ebr mbrojtjen e jet\u00ebs dhe t\u00eb sh\u00ebndetit t\u00eb t\u00eb d\u00ebnuarve, dhe duke mund\u00ebsuar leje te ve\u00e7ant\u00eb 3 mujore p\u00ebr nj\u00eb s\u00ebr\u00eb kategorish t\u00eb d\u00ebnuarish q\u00eb plot\u00ebsojn\u00eb kushtet dhe kriteret sipas Aktit Normativ s\u00eb sip\u00ebrcituar. Pra nga nj\u00ebra an\u00eb megjith\u00ebse n\u00eb m\u00ebnyr\u00eb krejt t\u00eb dyshimt\u00eb nga aspekti kushtetues K\u00ebshilli Ministrave nxjerr nj\u00eb akt normativ p\u00ebr \u201czbrazur\u201d burgjet, nga ana tjet\u00ebr Kuvendi miraton ndryshime n\u00eb Kodin Penal p\u00ebr t\u00eb d\u00ebnuar me burg ata q\u00eb nuk respektojn\u00eb masat e karantinimit. Leht\u00ebsisht mund t\u00eb supozohet q\u00eb frekuenca e shkel\u00ebsve mund t\u00eb jet\u00eb e konsiderueshme gj\u00eb q\u00eb do t\u00eb k\u00ebt\u00eb si rezultat mbushjen e institucioneve t\u00eb ekzekutimit t\u00eb vendimeve penale, prandaj me t\u00eb drejt\u00eb lind pyetja: A ka nj\u00eb politik\u00eb t\u00eb qart\u00eb penale n\u00eb lidhje menaxhimin e situat\u00ebs s\u00eb krijuar nga pandemia e Covid-19, dhe p\u00ebrse kjo kakofoni normative!?<\/p>\n<p style=\"text-align: justify;\">E arsyeshmja do t\u00eb ishte q\u00eb hyrje-daljet n\u00ebp\u00ebr institucionet e ekzekutimit t\u00eb vendimeve penale t\u00eb ishin sa m\u00eb t\u00eb ul\u00ebta madje p\u00ebr t\u00eb gjith\u00eb t\u00eb arrestuairit e rinj p\u00ebr aq sa t\u00eb ishte mund\u00ebsia t\u00eb zbatoheshin rregullat e karantinimit duke i mbajtur t\u00eb izoluar dhe vecuar nga t\u00eb d\u00ebnuarit e tjere q\u00eb gjenden n\u00eb institucion, me q\u00ebllim mbrojtjen e jet\u00ebs s\u00eb k\u00ebtyre t\u00eb fundit nga nj\u00eb infektim i mundsh\u00ebm.<\/p>\n<p style=\"text-align: justify;\">Si p\u00ebrfundim me bindje mund t\u00eb themi se ndryshimet e Kodit Penal, n\u00eb kuad\u00ebr t\u00eb masave parandaluese kund\u00ebr Covid-19, kan\u00eb q\u00ebn\u00eb jo proporcionale, t\u00eb panevojshme, t\u00eb ngutura, t\u00eb pajustifikuara dhe jan\u00eb objekt i nj\u00eb diskutimi t\u00eb r\u00ebnd\u00ebsish\u00ebm Kushtetues.
