{"id":13000,"date":"2021-05-19T09:08:21","date_gmt":"2021-05-19T09:08:21","guid":{"rendered":"https:\/\/shp.al\/?page_id=13000"},"modified":"2021-05-19T09:09:10","modified_gmt":"2021-05-19T09:09:10","slug":"ndryshime-ne-ligjin-per-statusin-e-gjyqtareve-dhe-prokuroreve-ne-republiken-e-shqiperise","status":"publish","type":"page","link":"https:\/\/shp.al\/sq\/azhurnime-ligjore\/ndryshime-ne-ligjin-per-statusin-e-gjyqtareve-dhe-prokuroreve-ne-republiken-e-shqiperise\/","title":{"rendered":"Ndryshime n\u00eb ligjin p\u00ebr Statusin e Gjyqtar\u00ebve dhe Prokuror\u00ebve n\u00eb Republik\u00ebn e Shqip\u00ebris\u00eb"},"content":{"rendered":"<p style=\"text-align: justify;\"><strong>Ligji Nr. 50\/2021 <\/strong>\u201c<em>P\u00ebr disa shtesa dhe ndryshime ne\u0308 ligjin nr. 96\/2016, \u201cP\u00ebr statusin e gjyqtar\u00ebve dhe prokuror\u00ebve n\u00eb Republik\u00ebn e Shqip\u00ebris\u00eb\u201d, te\u0308 ndryshuar<\/em>\u201d.<\/p>\n<p style=\"text-align: justify;\">Ligji nr. 50\/2021 \u00ebsht\u00eb botuar n\u00eb Fletoren Zyrtare nr. 71, dat\u00eb 14.05.2021, dhe hyn n\u00eb fuqi n\u00eb dat\u00ebn 30.05.2021.<\/p>\n<p style=\"text-align: justify;\">Ligji ka pe\u0308r qe\u0308llim te\u0308 zgjidhe\u0308 nje\u0308 se\u0308re\u0308 problematikash qe\u0308 jane\u0308 evidentuar gjate\u0308 zbatimit ne\u0308 praktike\u0308 te\u0308 ke\u0308tij ligji dhe gjate\u0308 implementimit te\u0308 procesit te\u0308 reforme\u0308s ne\u0308 drejte\u0308si. Problematikat e evidentuara lidhen me nevojat pe\u0308r nde\u0308rhyrje pe\u0308rmes ndryshimeve ne\u0308 ligjin nr. 96\/2016 te\u0308 cilat paraqiten si me\u0308 poshte\u0308:<\/p>\n<ul style=\"text-align: justify;\">\n<li><strong>Trajtimi financiar ne\u0308 skeme\u0308n e delegimit <\/strong><\/li>\n<\/ul>\n<p style=\"text-align: justify;\">Ligji parashikon disa shtesa dhe ndryshime qe\u0308 lidhen me mase\u0308n e kompensimit pe\u0308r she\u0308rbimin ne\u0308 skeme\u0308n e delegimit, pe\u0308r transferimin e pe\u0308rkohshe\u0308m dhe pe\u0308r caktim te\u0308 pe\u0308rkohshe\u0308m. Ne\u0308pe\u0308rmjet ke\u0308tyre ndryshimeve <strong>synohet qe\u0308 te\u0308 nxiten magjistrate\u0308t pe\u0308r te\u0308 qene\u0308 pjese\u0308 e skeme\u0308s se\u0308 delegimit, me qe\u0308llim qe\u0308 te\u0308 plote\u0308sohen vakancat qe\u0308 krijohen ne\u0308 gjykata ose prokurori<\/strong>.<\/p>\n<ul style=\"text-align: justify;\">\n<li><strong>Magjistrat\u00ebt n\u00eb skem\u00ebn e delegimit.<\/strong><\/li>\n<\/ul>\n<p style=\"text-align: justify;\">Ndryshime pe\u0308son edhe neni 45 mbi skeme\u0308n e delegimit duke prezantuar edhe <strong>munde\u0308sine\u0308 e caktimit te\u0308 magjistratit pe\u0308r hetimin ose gjykimin e nje\u0308 ose disa c\u0327e\u0308shtjeve te\u0308 vec\u0327anta ne\u0308 nje\u0308 gjykate\u0308 ose prokurori, pe\u0308r te\u0308 cile\u0308n magjistrati pe\u0308rmbush ke\u0308rkesat<\/strong>. N\u00eb rastet kur caktohet p\u00ebr hetimin ose gjykimin e nj\u00eb ose disa \u00e7\u00ebshtjeve t\u00eb ve\u00e7anta n\u00eb gjykat\u00ebn e posa\u00e7me p\u00ebr gjykimin e veprave penale kund\u00ebr korrupsionit dhe krimit t\u00eb organizuar ose Prokurorin\u00eb e Posa\u00e7me, magjistrati duhet t\u00eb p\u00ebrmbush\u00eb kriteret, si dhe t\u00eb jap\u00eb p\u00eblqimin sipas nenit 47 t\u00eb k\u00ebtij ligji. Delegimi p\u00ebr nj\u00eb \u00e7\u00ebshtje t\u00eb ve\u00e7ant\u00eb kryhet kur gjyqtar\u00ebt ose prokuror\u00ebt e nj\u00eb gjykate ose prokurorie jan\u00eb ligj\u00ebrisht t\u00eb padisponuesh\u00ebm p\u00ebr gjykimin ose hetimin e nj\u00eb apo disa \u00e7\u00ebshtjeve.<\/p>\n<p style=\"text-align: justify;\"><strong>Shtesa pe\u0308r ve\u0308shtire\u0308si dhe pe\u0308r shkak te\u0308 heqjes dore\u0308 nga private\u0308sia pe\u0308r prokurore\u0308t e Prokurorise\u0308 se\u0308 Posacme dhe gjyqtare\u0308t e Gjykatave te\u0308 Posac\u0327me<\/strong><strong>.<\/strong><\/p>\n<p style=\"text-align: justify;\">Pe\u0308r prokurore\u0308t e SPAK si dhe gjyqtare\u0308t e Gjykatave te\u0308 Posac\u0327me e\u0308shte\u0308 parashikuar shtesa pe\u0308r ve\u0308shtire\u0308si (qe\u0308 me\u0308 pare\u0308 ishte ne\u0308 mase\u0308n 60 pe\u0308rqind te\u0308 page\u0308s fillestare bruto) dhe shtesa pe\u0308r heqjen dore\u0308 nga private\u0308sia (e cila nuk ishte parashikuar si shtese\u0308 me\u0308 pare\u0308), ne\u0308 mase\u0308n 80 pe\u0308rqind te\u0308 page\u0308s fillestare bruto.<\/p>\n<ul style=\"text-align: justify;\">\n<li><strong>Rregullimi i skeme\u0308s se\u0308 pensionit te\u0308 parakohshe\u0308m <\/strong><\/li>\n<\/ul>\n<p style=\"text-align: justify;\">Ne\u0308 vazhde\u0308n e garancive qe\u0308 i ofrohen magjistrate\u0308ve, e\u0308shte\u0308 parashikuar edhe e drejta pe\u0308r pension te\u0308 parakohshe\u0308m pe\u0308rmes shtimit te\u0308 pike\u0308s 1\/1 ne\u0308 nenin 27, duke e pe\u0308rcaktuar ate\u0308 si e drejte\u0308 e cila ge\u0308zohet edhe kur Ke\u0308shilli vendos mbarimin e statusit te\u0308 magjistratit pe\u0308r shkak te\u0308 pamunde\u0308sise\u0308 fizike dhe mendore sipas parashikimeve te\u0308 ligjit. Gjithashtu, ne\u0308 pike\u0308n 1\/2 e\u0308shte\u0308 pe\u0308rcaktuar se pensioni i parakohshe\u0308m e\u0308shte\u0308 nje\u0308 pension pleqe\u0308rie i reduktuar dhe mbetet i reduktuar gjate\u0308 gjithe\u0308 kohe\u0308s se\u0308 pe\u0308rfitimit, deri ne\u0308 plote\u0308simin e kushteve pe\u0308r pe\u0308rfitimin e pensionit te\u0308 plote\u0308 te\u0308 pleqe\u0308rise\u0308, si dhe me\u0308nyra e llogaritjes se\u0308 tij.<\/p>\n<ul style=\"text-align: justify;\">\n<li><strong>Qarte\u0308simi i kritereve pe\u0308r rekrutimin e magjistrate\u0308ve<\/strong><\/li>\n<\/ul>\n<p style=\"text-align: justify;\">Ndryshime te\u0308 re\u0308nde\u0308sishme jane\u0308 kryer edhe ne\u0308 qarte\u0308simin e kritereve pe\u0308r rekrutimin e kandidate\u0308ve pe\u0308r magjistrate\u0308. Ne\u0308 ke\u0308te\u0308 kuptim, e\u0308shte\u0308 rregulluar qe\u0308 <strong>3 vite eksperience\u0308 pune konsiderohet vete\u0308m pas pe\u0308rfundimit te\u0308 programit te\u0308 plote\u0308 te\u0308 studimeve<\/strong>. Gjithashtu, ne\u0308pe\u0308rmjet ke\u0308tij ndryshimi unifikohet edhe terminologjia e parashikuar ne\u0308 ligjin nr. 80\/2015 \u201cPe\u0308r arsimin e larte\u0308 dhe ke\u0308rkimin shkencor ne\u0308 institucionet e arsimit te\u0308 larte\u0308 ne\u0308 Republike\u0308n e Shqipe\u0308rise\u0308\u201d. <strong>Ligji parashikon si kritere ndaluese: <\/strong><\/p>\n<p style=\"text-align: justify;\">(a) <strong>de\u0308nimin me vendim penal te\u0308 forme\u0308s se\u0308 prere\u0308 pe\u0308r kryerjen e nje\u0308 vepre penale<\/strong> qe\u0308, pe\u0308r shkak te\u0308 natyre\u0308s se\u0308 vepre\u0308s se\u0308 kryer, diskrediton pozite\u0308n dhe figure\u0308n e gjyqtarit ose prokurorit, ose de\u0308mton re\u0308nde\u0308 besimin e publikut ne\u0308 sistemin gjyqe\u0308sor, <strong>pavare\u0308sisht ne\u0308se e\u0308shte\u0308 rehabilituar sipas parashikimeve te\u0308 Kodit Penal<\/strong> dhe<\/p>\n<p style=\"text-align: justify;\">(b<strong>) largimin nga detyra ose heqjen e licence\u0308s, autorizimit<\/strong> ose lejes pe\u0308r ushtrimin e nje\u0308 profesioni pe\u0308r shkaqe disiplinore<strong>, pavare\u0308sisht ne\u0308se masa disiplinore konsiderohet e shuar, si dhe pasja e masave disiplinore ne\u0308 fuqi<\/strong>.<\/p>\n<ul style=\"text-align: justify;\">\n<li><strong>Rregullat mbi pe\u0308rfundimin e statusit dhe zgjatja e tij <\/strong><\/li>\n<\/ul>\n<p style=\"text-align: justify;\">Me qe\u0308llim sigurimin e vazhdime\u0308sise\u0308 ne\u0308 funksion deri ne\u0308 momentin e ze\u0308vende\u0308simit te\u0308 magjistrate\u0308ve, pe\u0308r te\u0308 garantuar ushtrimin e funksionit pe\u0308r nje\u0308 periudhe\u0308 me\u0308 te\u0308 gjate\u0308, si dhe ne\u0308 me\u0308nyre\u0308 qe\u0308 te\u0308 sigurohet eficenca dhe efektiviteti i gjykatave dhe prokurorive, jane\u0308 be\u0308re\u0308 ndryshime ne\u0308 nenin 64 qe\u0308 lidhen me moshe\u0308n e pensionit duke pe\u0308rcaktuar se magjistrati del ne\u0308 pension ne\u0308 moshe\u0308n 67 vjec\u0327 por, me ke\u0308rkese\u0308n e tij, mund te\u0308 qe\u0308ndroje\u0308 ne\u0308 detyre\u0308 deri ne\u0308 moshe\u0308n 70 vjec\u0327.<\/p>\n<ul style=\"text-align: justify;\">\n<li><strong>Verifikimi i past\u00ebrtis\u00eb s\u00eb figur\u00ebs <\/strong><\/li>\n<\/ul>\n<p style=\"text-align: justify;\">Jan\u00eb b\u00ebr\u00eb ndryshime t\u00eb r\u00ebnd\u00ebsishme p\u00ebrsa i p\u00ebrket verifikimit t\u00eb past\u00ebrtis\u00eb s\u00eb figur\u00ebs s\u00eb magjistrat\u00ebve duke mir\u00ebp\u00ebrcaktuar rastet kur kandidati nuk kalon procesin e verifikimit t\u00eb pasuris\u00eb dhe figur\u00ebs, vler\u00ebsimin e dokumentacionit t\u00eb p\u00ebrcjell\u00eb nga organet raportuese p\u00ebr efekt t\u00eb procesit t\u00eb vler\u00ebsimit nga ana e K\u00ebshillave. Tashm\u00eb K\u00ebshillat (KLGJ, KLP) duhet t\u00eb \u00e7mojn\u00eb faktet n\u00eb baz\u00eb t\u00eb nj\u00eb vler\u00ebsimi n\u00eb m\u00ebnyr\u00eb t\u00eb holl\u00ebsishme t\u00eb raporteve dhe informacioneve shtes\u00eb t\u00eb paraqitura nga institucionet kompetente dhe t\u00eb zhvillojn\u00eb nj\u00eb hetim administrativ sipas parashikimeve t\u00eb Kodit t\u00eb Procedurave Administrative.<\/p>\n<p style=\"text-align: justify;\">I gjith\u00eb ky proces synon q\u00eb t\u00eb rris\u00eb efektivitetin dhe rezultatet e procesit t\u00eb verifikimit q\u00eb kryejn\u00eb K\u00ebshillat duke mos u mjaftuar vet\u00ebm n\u00eb vler\u00ebsimin e raporteve t\u00eb institucioneve kompetente por duke thelluar analiz\u00ebn e tyre mbi faktet e prezantuara.<\/p>\n<p style=\"text-align: justify;\">N\u00eb kuad\u00ebr t\u00eb k\u00ebtij procesi jan\u00eb garantuar dhe t\u00eb drejtat e kandidat\u00ebve p\u00ebr t\u2019u njohur me dosjen e tyre dhe ankimin pran\u00eb gjykat\u00ebs kompetente ndaj vendimit t\u00eb K\u00ebshillave brenda 5 dit\u00ebve.<\/p>\n<ul style=\"text-align: justify;\">\n<li><strong>Em\u00ebrimi i kandidatit magjistrat t\u00eb diplomuar <\/strong><\/li>\n<\/ul>\n<p style=\"text-align: justify;\">\u00cbsht\u00eb shfuqizuar pika 3 e nenit 35 t\u00eb ligjit sipas\u00a0 s\u00eb cil\u00ebs parashikohej se kandidat\u00ebt p\u00ebr magjistrat\u00eb duhet t\u00eb k\u00ebrkonin em\u00ebrimin si magjistrat n\u00ebp\u00ebrmjet nj\u00eb k\u00ebrkese me shkrim drejtuar k\u00ebshillit duke p\u00ebrcaktuar edhe renditjen preferenciale. Nga ana tjet\u00ebr \u00ebsht\u00eb rregulluar em\u00ebrimi i magjistratit n\u00eb vitin pasardh\u00ebs i cili megjith\u00ebse si i diplomuar p\u00ebrmbush kriteret p\u00ebr tu em\u00ebruar si magjistrat,\u00a0 p\u00ebr shkaqe t\u00eb justifikuara mund t\u00eb k\u00ebrkoj\u00eb q\u00eb t\u00eb em\u00ebrohet si magjistrat n\u00eb vitin pasardh\u00ebs. N\u00eb vijim K\u00ebshillat mund t\u00eb vendosin:<\/p>\n<p>a) t\u00eb em\u00ebrojn\u00eb magjistrat \u00e7do person q\u00eb \u00ebsht\u00eb n\u00eb list\u00ebn e t\u00eb diplomuarve, i cili p\u00ebrmbush kriteret e em\u00ebrimit, ose refuzojn\u00eb t\u00eb em\u00ebrojn\u00eb magjistrat \u00e7do person q\u00eb \u00ebsht\u00eb n\u00eb list\u00ebn e t\u00eb diplomuarve, por q\u00eb nuk p\u00ebrmbush kriteret e em\u00ebrimit;<\/p>\n<p>b) lejojn\u00eb kandidatin q\u00eb p\u00ebrmbush kriteret e em\u00ebrimit p\u00ebr t\u2019u em\u00ebruar n\u00eb vitin pasardh\u00ebs, pas paraqitjes s\u00eb k\u00ebrkes\u00ebs sipas pik\u00ebs 2 t\u00eb k\u00ebtij neni.<\/p>\n<ul style=\"text-align: justify;\">\n<li><strong>Riem\u00ebrimi magjistrat i ish-gjyqtar\u00ebve dhe ish-prokuror\u00ebve<\/strong><\/li>\n<\/ul>\n<p style=\"text-align: justify;\">Ligji i ri <strong>ndryshon procedur\u00ebn<\/strong> dhe kriteret e riem\u00ebrimit si magjistrat <strong>t\u00eb ish-gjyqtar\u00ebve dhe ish-prokuror\u00ebve<\/strong>, t\u00eb cil\u00ebt mund t\u00eb kandidojn\u00eb p\u00ebr t\u2019u riem\u00ebruar, <strong>por vet\u00ebm n\u00eb rastet<\/strong> kur K\u00ebshillat (KLGJ dhe KLP) konstatojn\u00eb se <strong>numri i vendeve t\u00eb lira \u00ebsht\u00eb m\u00eb i madh se numri i t\u00eb diplomuarve q\u00eb p\u00ebrmbushin kriteret<\/strong>. N\u00eb k\u00ebt\u00eb rast ish-gjyqtar\u00ebt dhe ish-prokuror\u00ebt kan\u00eb mund\u00ebsi t\u00eb riem\u00ebrohen n\u00ebse kan\u00eb ushtruar funksionin e magjistratit t\u00eb pakt\u00ebn 5 vjet n\u00eb 15 vitet e fundit, n\u00eb ndryshim me kriteret q\u00eb jan\u00eb n\u00eb fuqi sot, sipas s\u00eb cilave kushti \u00ebsht\u00eb q\u00eb t\u00eb jen\u00eb diplomuar n\u00eb Shkoll\u00ebn e Magjistratur\u00ebs dhe t\u00eb ken\u00eb ushtruar funksionin e magjistratit t\u00eb pakt\u00ebn 5 vjet n\u00eb 15 vitet e fundit.<\/p>\n<ul style=\"text-align: justify;\">\n<li><strong>Pro\u00e7edura e l\u00ebvizjes paralele<\/strong><\/li>\n<\/ul>\n<p style=\"text-align: justify;\">Ndryshime jan\u00eb parashikuar edhe n\u00eb pro\u00e7edur\u00ebn e l\u00ebvizjes paralele (nen 43) ku shkronja \u201cb\u201d e pik\u00ebs 2 shfuqizohet dhe n\u00eb pik\u00ebn 5 p\u00ebrcaktohen rregullat mbi renditjen e preferencave. Gjithashtu n\u00eb pik\u00ebn 7, shkronja \u201ca\u201d, n\u00ebnparagrafi \u201ci\u201d jan\u00eb parashikuar ndryshime p\u00ebr ti dh\u00ebn\u00eb p\u00ebrpar\u00ebsi p\u00ebrvoj\u00ebs n\u00eb pozicionet e komanduara, si magjistrat n\u00eb skem\u00ebn e delegimit q\u00eb i ka mbaruar afati i caktimit ose delegimit, si an\u00ebtar i K\u00ebshillit q\u00eb i ka mbaruar mandati tre vjet p\u00ebrpara kandidimit, si gjyqtar i Gjykat\u00ebs Kushtetuese, si an\u00ebtar i Kolegjit Zgjedhor q\u00eb i ka mbaruar mandati ose \u00e7do pozicion tjet\u00ebr q\u00eb ligji e p\u00ebrcakton si vler\u00eb t\u00eb shtuar, n\u00eb m\u00ebnyr\u00eb q\u00eb t\u00eb garantohet nj\u00eb vler\u00ebsim dhe shp\u00ebrblim i drejt\u00eb i k\u00ebtyre p\u00ebrvojave.<\/p>\n<ul style=\"text-align: justify;\">\n<li><strong>Komandimi i magjistrat\u00ebve n\u00eb organizatat nd\u00ebrkomb\u00ebtare<\/strong><\/li>\n<\/ul>\n<p style=\"text-align: justify;\">Nj\u00eb c\u00ebshtje q\u00eb ka gjetur rregullim n\u00ebp\u00ebrmjet k\u00ebtyre ndryshimeve \u00ebsht\u00eb edhe <strong>komandimi i magjistrat\u00ebve n\u00eb organizatat nd\u00ebrkomb\u00ebtare<\/strong>. P\u00ebr k\u00ebt\u00eb q\u00ebllim, jan\u00eb parashikuar ndryshime n\u00eb nenin 53 t\u00eb ligjit, p\u00ebrmjet t\u00eb cilit parashikohet q\u00eb magjistrati q\u00eb komandohet n\u00eb nj\u00eb organizat\u00eb nd\u00ebrkomb\u00ebtare, me q\u00ebllim p\u00ebrfaq\u00ebsimin e Republik\u00ebs s\u00eb Shqip\u00ebris\u00eb n\u00eb at\u00eb organizat\u00eb, <strong>g\u00ebzon t\u00eb nj\u00ebjtin status me diplomat\u00ebt<\/strong>, sipas parashikimeve t\u00eb ligjit n\u00eb fuqi p\u00ebr sh\u00ebrbimin e jasht\u00ebm t\u00eb Republik\u00ebs s\u00eb Shqip\u00ebris\u00eb.<\/p>\n<ul style=\"text-align: justify;\">\n<li><strong>Rregullime me karakter te\u0308 pe\u0308rkohshe\u0308m <\/strong><\/li>\n<\/ul>\n<p style=\"text-align: justify;\">Ligji ka sanksionuar shtimin e dy neneve me karakter tranzitor qe\u0308 lidhet me caktimin e magjistrate\u0308ve ne\u0308 c\u0327e\u0308shtje te\u0308 vec\u0327anta dhe caktimin e pe\u0308rkohshe\u0308m ne\u0308 pozicione te\u0308 lira te\u0308 pe\u0308rkohshme.<\/p>\n<ol style=\"text-align: justify;\">\n<li><strong>Caktimi i magjistrat\u00ebve p\u00ebr \u00e7\u00ebshtje t\u00eb ve\u00e7anta<\/strong>\n<p style=\"text-align: justify;\">N\u00eb rastin kur n\u00eb skem\u00ebn e delegimit <strong>nuk ka magjistrat t\u00eb disponuesh\u00ebm<\/strong> dhe <strong>transferimi i p\u00ebrkohsh\u00ebm i magjistrat\u00ebve \u00ebsht\u00eb i padobish\u00ebm<\/strong> p\u00ebr mbar\u00ebvajtjen e sistemit gjyq\u00ebsor, K\u00ebshillat mund <strong>t\u00eb caktojn\u00eb nj\u00eb magjistrat p\u00ebr gjykimin ose hetimin e \u00e7\u00ebshtjeve t\u00eb ve\u00e7anta <\/strong>n\u00eb nj\u00eb gjykat\u00eb ose prokurori t\u00eb ndryshme nga ajo ku ai ushtron funksionin n\u00eb m\u00ebnyr\u00eb t\u00eb p\u00ebrhershme n\u00eb rastet e m\u00ebposhtme:<\/p>\n<p>a) kur nuk ka nj\u00eb num\u00ebr t\u00eb mjaftuesh\u00ebm gjyqtar\u00ebsh ose prokuror\u00ebsh n\u00eb nj\u00eb gjykat\u00eb ose prokurori;
