{"id":12990,"date":"2021-05-19T08:46:03","date_gmt":"2021-05-19T08:46:03","guid":{"rendered":"https:\/\/shp.al\/?page_id=12990"},"modified":"2021-05-19T08:53:03","modified_gmt":"2021-05-19T08:53:03","slug":"ndryshime-te-rendesishme-ne-ligjin-per-organizimin-e-pushtetit-gjyqesor-ne-republiken-e-shqiperise","status":"publish","type":"page","link":"https:\/\/shp.al\/sq\/azhurnime-ligjore\/ndryshime-te-rendesishme-ne-ligjin-per-organizimin-e-pushtetit-gjyqesor-ne-republiken-e-shqiperise\/","title":{"rendered":"Ndryshime t\u00eb r\u00ebnd\u00ebsishme n\u00eb ligjin p\u00ebr organizimin e Pushtetit Gjyq\u00ebsor n\u00eb Republik\u00ebn e Shqip\u00ebris\u00eb"},"content":{"rendered":"<p style=\"text-align: justify;\"><strong>Ligji Nr. 46\/2021 <\/strong>\u201c<em>P\u00ebr disa shtesa dhe ndryshime ne\u0308 ligjin nr. 98\/2016, \u201cP\u00ebr organizimin e pushtetit gjyq\u00ebsor n\u00eb Republik\u00ebn e Shqip\u00ebris\u00eb<\/em>\u201d.<\/p>\n<p style=\"text-align: justify;\">Ligji nr. 46\/2021 \u00ebsht\u00eb botuar n\u00eb Fletoren Zyrtare nr. 71, dat\u00eb 14.05.2021, dhe hyn n\u00eb fuqi n\u00eb dat\u00ebn 30.05.2021.<\/p>\n<p style=\"text-align: justify;\">Ligji ka pe\u0308r qe\u0308llim rregullimin e situat\u00ebs s\u00eb krijuar n\u00eb sistemin gjyq\u00ebsor si pasoj\u00eb e procesit t\u00eb rivler\u00ebsimit kalimtar t\u00eb gjyqtar\u00ebve dhe prokuror\u00ebve, i cili ka sjell\u00eb shkarkimin e nj\u00eb numri t\u00eb madh gjyqtar\u00ebsh, duke ndikuar k\u00ebshtu n\u00eb mbar\u00ebvajtjen e veprimtaris\u00eb s\u00eb gjykatave dhe respektimin e afateve pro\u00e7eduriale dhe pro\u00e7esit t\u00eb rregullt gjyq\u00ebsor.<\/p>\n<p style=\"text-align: justify;\">P\u00ebrmes k\u00ebtyre ndryshimeve rregullohen disa aspekte q\u00eb kan\u00eb t\u00eb b\u00ebjn\u00eb me organizimin, funksionimin, kompetencat e organizimin e brendsh\u00ebm t\u00eb gjykatave, si dhe funksionimin e administrat\u00ebs s\u00eb gjykat\u00ebs, duke synuar ta b\u00ebjn\u00eb m\u00eb efektive. Ne\u0308 me\u0308nyre\u0308 te\u0308 pe\u0308rmbledhur disa nga ndryshimet jane\u0308 si me\u0308 poshte\u0308:<\/p>\n<ul style=\"text-align: justify;\">\n<li><strong>Ndihm\u00ebsit ligjor\u00eb <\/strong><\/li>\n<\/ul>\n<p style=\"text-align: justify;\">Ligji ka parashikuar q\u00eb ndihm\u00ebsit ligjor\u00eb t\u00eb ushtrojn\u00eb funksionin e tyre n\u00eb nj\u00ebsin\u00eb e sh\u00ebrbimit ligjor <strong>jo vet\u00ebm pran\u00eb gjykatave t\u00eb apelit<\/strong> por <strong>edhe pran\u00eb gjykatave t\u00eb shkall\u00ebs s\u00eb par\u00eb<\/strong>, gjithashtu <strong>\u00ebsht\u00eb rritur numri i tyre<\/strong> nga jo n\u00eb shum\u00eb se gjysma e numrit t\u00eb gjyqtar\u00ebve q\u00eb ishte n\u00eb jo m\u00eb shum\u00eb se <strong>numri i p\u00ebrgjithsh\u00ebm i gjyqtar\u00ebve<\/strong>.<\/p>\n<p style=\"text-align: justify;\">N\u00eb kuad\u00ebr t\u00eb shtrirjes s\u00eb veprimtaris\u00eb s\u00eb tyre n\u00eb gjykat\u00ebn e shkall\u00ebs s\u00eb par\u00eb dhe n\u00eb gjykat\u00ebn e apelit \u00ebsht\u00eb parashikuar q\u00eb <strong>K\u00ebshilli i Lart\u00eb Gjyq\u00ebsor<\/strong>, p\u00ebrve\u00e7 verifikimit t\u00eb plot\u00ebsimit t\u00eb kritereve <strong>t\u00eb kryej\u00eb edhe verifikimin e pasuris\u00eb dhe figur\u00ebs s\u00eb ndihm\u00ebsit ligjor<\/strong> nj\u00ebsoj si p\u00ebr verifikimin q\u00eb kryhet ndaj kandidat\u00ebve n\u00eb formimin fillestar p\u00ebr magjistrat\u00eb.<\/p>\n<p style=\"text-align: justify;\">Gjithashtu <strong>\u00ebsht\u00eb ndryshuar kriteri i p\u00ebrvoj\u00ebs profesionale<\/strong> i cili aktualisht \u00ebsht\u00eb jo m\u00eb pak se 5 vite p\u00ebrvoj\u00eb duke p\u00ebrfshir\u00eb s\u00eb paku 3 vjet p\u00ebrvoj\u00eb pune profesionale q\u00eb lidhet me gjykat\u00ebn. Ndryshimi n\u00eb lidhje me k\u00ebt\u00eb kriter <strong>parashikon q\u00eb kandidat\u00ebt t\u00eb ken\u00eb p\u00ebrvoj\u00eb profesionale jo m\u00eb pak se 3 vjet<\/strong> si n\u00ebpun\u00ebs n\u00eb sistemin gjyq\u00ebsor ose t\u00eb prokuroris\u00eb, n\u00eb administrat\u00ebn publike, profesionet e lira ligjore, m\u00ebsimdh\u00ebnie n\u00eb fakultetet e drejt\u00ebsis\u00eb, ose n\u00eb \u00e7do pozicion tjet\u00ebr t\u00eb barasvlersh\u00ebm me to, n\u00eb sektorin privat ose n\u00eborganizatat nd\u00ebrkomb\u00ebtare.<\/p>\n<ul style=\"text-align: justify;\">\n<li><strong>Deg\u00ebt e gjykatave <\/strong><\/li>\n<\/ul>\n<p style=\"text-align: justify;\">Deg\u00ebt e gjykatave me ligjin aktual gjykojn\u00eb vet\u00ebm \u00e7\u00ebshtje t\u00eb cilat nuk jan\u00eb urgjente. Ligji i ri ka shfuqizuar parashikimin e m\u00ebsip\u00ebrm duke i l\u00ebn\u00eb hapsir\u00ebn k\u00ebshtu q\u00eb k\u00ebto deg\u00eb t\u00eb mund t\u00eb gjykojn\u00eb \u00e7\u00ebshtje civile dhe penale q\u00eb gjykohen nga nj\u00eb gjyqtar i vet\u00ebm, duke p\u00ebrfshir\u00eb edhe c\u00ebshtjet t\u00eb cilat jan\u00eb urgjente.<\/p>\n<ul style=\"text-align: justify;\">\n<li><strong>Ndryshimi i pe\u0308rbe\u0308rjes se\u0308 trupave gjykuese <\/strong><\/li>\n<\/ul>\n<p style=\"text-align: justify;\">Dispozita mbi p\u00ebrb\u00ebrjen e trupit gjykues \u00ebsht\u00eb ndryshuar me q\u00ebllim q\u00eb t\u00eb harmonizohet me parashikimet n\u00eb ligjet e tjera pro\u00e7eduriale.<\/p>\n<p style=\"text-align: justify;\">Dispozita e cila parashikon se c\u00ebshtjet penale t\u00eb gjykuara nga gjykatat e posa\u00e7me p\u00ebr gjykimin e veprave penale t\u00eb korrupsionit dhe krimit t\u00eb organizuar gjykohen nga nj\u00eb trup gjykues i p\u00ebrb\u00ebr\u00eb nga <strong>5 gjyqtar\u00eb \u00ebsht\u00eb shfuqizuar<\/strong> n\u00eb m\u00ebnyr\u00eb q\u00eb edhe <strong>k\u00ebto \u00e7\u00ebshtje t\u00eb shqyrtohen nga nj\u00eb trup gjykues i p\u00ebrb\u00ebr\u00eb nga 3 gjyqtar\u00eb<\/strong>.<\/p>\n<ul style=\"text-align: justify;\">\n<li><strong>Kryetari dhe z\u00ebvend\u00ebskryetari i gjykat\u00ebs<\/strong><\/li>\n<\/ul>\n<p style=\"text-align: justify;\">Ligji sjell ndryshime edhe p\u00ebrsa i p\u00ebrket zgjedhjes s\u00eb z\u00ebvend\u00ebskryetarit t\u00eb gjykat\u00ebs, duke par\u00eb vakancat e krijuara nga procesi i rivler\u00ebsimit t\u00eb gjyqtar\u00ebve dhe prokuror\u00ebve. Ligji parashikon disa zgjidhje n\u00eb m\u00ebnyr\u00eb q\u00eb kompetencat e kryetarit t\u00eb gjykat\u00ebs t\u00eb mos mbeten pa ushtruar, n\u00ebprmjet garantimit t\u00eb zgjedhjes s\u00eb z\u00ebvend\u00ebskryetarit. K\u00ebshtu z\u00ebvend\u00ebskryetari do t\u00eb zgjidhet nga mbledhja e p\u00ebrgjithshme e gjyqtar\u00ebve nd\u00ebrmjet gjyqtar\u00ebve q\u00eb ushtrojn\u00eb detyr\u00ebn n\u00eb at\u00eb gjykat\u00eb. Kriteri aktual i p\u00ebrvoj\u00ebs profesionale q\u00eb aktualisht \u00ebsht\u00eb 5 vjet p\u00ebrvoj\u00eb profesionale si gjyqtar, nga t\u00eb cilat t\u00eb pakt\u00ebn 3 vjet n\u00eb t\u00eb nj\u00ebjt\u00ebn shkall\u00eb, lihet i pandryshuar, por deri n\u00eb p\u00ebrfundimin e procesit t\u00eb rivler\u00ebsimit kalimtar t\u00eb gjyqtar\u00ebve dhe prokuror\u00ebve sipas ligjit, \u00ebsht\u00eb parashikuar nj\u00eb dispozit\u00eb kalimtare sipas s\u00eb cil\u00ebs kandidati p\u00ebr z\u00ebvend\u00ebskryetar t\u00eb gjykat\u00ebs s\u00eb shkall\u00ebs s\u00eb par\u00eb duhet t\u00eb ket\u00eb t\u00eb pakt\u00ebn 3 vjet p\u00ebrvoj\u00eb profesionale si gjyqtar nd\u00ebrsa kandidati p\u00ebr z\u00ebvend\u00ebskryetar t\u00eb gjykat\u00ebs s\u00eb apelit duhet t\u00eb ket\u00eb t\u00eb pakt\u00ebn 3 vjet p\u00ebrvoj\u00eb profesionale si gjyqtar i gjykt\u00ebs s\u00eb apelit.<\/p>\n<p style=\"text-align: justify;\">Nd\u00ebrkoh\u00eb \u00ebsht\u00eb parashikuar edhe nj\u00eb mekaniz\u00ebm tjet\u00ebr zhbllokues sipas t\u00eb cilit kur nuk konkuron asnj\u00eb nga gjyqtar\u00ebt q\u00eb plot\u00ebsojn\u00eb kriterin e p\u00ebrvoj\u00ebs minimale profesionale, ose kur asnj\u00eb nga gjyqtar\u00ebt\u00a0 e gjykat\u00ebs nuk e ka k\u00ebt\u00eb p\u00ebrvoj\u00eb, z\u00ebvend\u00ebskryetari i gjykat\u00ebs zgjidhet n\u00ebp\u00ebrmjet gjyqtar\u00ebve t\u00eb tjer\u00eb q\u00eb ushtrojn\u00eb funksionin n\u00eb at\u00eb gjykat\u00eb, p\u00ebr nj\u00eb mandat j\u00ebvjecar me t\u00eb drejt\u00eb rizgjedhje.<\/p>\n<ul style=\"text-align: justify;\">\n<li><strong>Kolegjet dhe trupat gjykues t\u00eb Gjykat\u00ebs s\u00eb Lart\u00eb<\/strong><\/li>\n<\/ul>\n<p style=\"text-align: justify;\">Ndryshime t\u00eb r\u00ebnd\u00ebsishme jan\u00eb parashikuar edhe p\u00ebrsa i p\u00ebrket dispozitave q\u00eb lidhen me Kolegjet e Gjykat\u00ebs s\u00eb Lart\u00eb. Konkretisht \u00ebsht\u00eb parashikuar q\u00eb:<\/p>\n<ol>\n<li style=\"list-style-type: none;\">\n<ol style=\"text-align: justify;\">\n<li><strong>Kolegji Civil dhe Kolegji Penal<\/strong> gjykon n\u00eb kolegj me trup gjykues t\u00eb p\u00ebrb\u00ebr\u00eb nga <strong>3 gjyqtar\u00eb<\/strong>;<\/li>\n<li><strong>Kolegji Administrativ gjykon me 3 gjyqtar\u00eb t\u00eb gjitha \u00e7\u00ebshtjet<\/strong>, me p\u00ebrjashtim t\u00eb rekurseve t\u00eb paraqitura kund\u00ebr vendimeve t\u00eb Gjykat\u00ebs Administrative t\u00eb Apelit, q\u00eb kan\u00eb shqyrtuar padi ndaj aktit n\u00ebnligjor normativ, t\u00eb cilat gjykohen me 5 gjyqtar\u00eb.<\/li>\n<li>Gjithashtu parashikohet edhe se <strong>pe\u0308r nje\u0308simin dhe zhvillimin e praktike\u0308s gjyqe\u0308sore, Gjykata e Larte\u0308 gjykon ne\u0308 kolegj me trup gjykues te\u0308 pe\u0308rbe\u0308re\u0308 nga 5 gjyqtare\u0308. <\/strong><\/li>\n<li>Gjithashtu \u00ebsht\u00eb qart\u00ebsuar edhe kompetenca e Kolegjeve t\u00eb Bashkuar p\u00ebr nj\u00ebsimin e praktik\u00ebs gjyq\u00ebsore. K\u00ebshtu n\u00eb parashikimet aktuale rezulton se Kolegjet e Bashkuara shqyrtojn\u00eb rastet kur e nj\u00ebjta c\u00ebshtje juridike nuk \u00ebsht\u00eb interpretuar n\u00eb m\u00ebnyr\u00eb t\u00eb nj\u00ebjt\u00eb nga kolegje t\u00eb ndryshme t\u00eb Gjykat\u00ebs s\u00eb Lart\u00eb, ose n\u00eb rast se ekziston rreziku p\u00ebr interpretim jo t\u00eb nj\u00ebjt\u00eb nga kolegje t\u00eb ndryshme t\u00eb Gjykat\u00ebs s\u00eb Lart\u00eb.
