Gjykata Kushtetuese ka shfuqizuar m\u00ebnyr\u00ebn e vler\u00ebsimit financiar q\u00eb b\u00ebhet nga ATP-ja dhe ka detyruar kuvendin q\u00eb brenda dat\u00ebs 12 korrik 2021 t\u00eb plot\u00ebsoj\u00eb ligjin duke b\u00ebr\u00eb vler\u00ebsimin e kompensimit financiar n\u00eb p\u00ebrputhje me vendimin e saj"},"content":{"rendered":"<p style=\"text-align: justify;\"><strong>Gjykata Kushtetuese me Vendimin nr. 4, dat\u00eb 08.03.2021 ka vendosur:<\/strong><\/p>\n<p style=\"text-align: justify;\"><strong>\u00a0<\/strong>\u2013 Shfuqizimin si t\u00eb papajtuesh\u00ebm me Kushtetut\u00ebn t\u00eb nenit 7, pika 2, shkronjat \u201ca\u201d <em>dhe \u201cb\u201d, t\u00eb ligjit nr. 133\/2015, \u201cP\u00ebr trajtimin e pron\u00ebs dhe p\u00ebrfundimin e pro\u00e7esit t\u00eb kompensimit t\u00eb pronave\u201d.<\/em><\/p>\n<p style=\"text-align: justify;\"><em>\u2013 Shfuqizimin si t\u00eb papajtuesh\u00ebm me Kushtetut\u00ebn t\u00eb\u00a0 pikave 16\/2, 16\/4 dhe 18 t\u00eb VKM-s\u00eb nr. 223, dat\u00eb 23.3.2016, \u201cP\u00ebr p\u00ebrcaktimin e rregullave dhe t\u00eb pro<\/em>\u00e7<em>edurave p\u00ebr vler\u00ebsimin dhe shp\u00ebrndarjen e fondit financiar e fizik p\u00ebr kompensimin e pronave\u201d, t\u00eb ndryshuar.<\/em><\/p>\n<p style=\"text-align: justify;\"><em>&#8211; Rr\u00ebzimin e k\u00ebrkes\u00ebs p\u00ebr k\u00ebrkimet e tjera.<\/em><\/p>\n<p style=\"text-align: justify;\"><em>&#8211; Detyrimin e Kuvendit t\u00eb Shqip\u00ebris\u00eb t\u00eb plot\u00ebsoj\u00eb ligjin nga data e shpalljes s\u00eb vendimit t\u00eb Gjykat\u00ebs Kushtetuese deri n\u00eb hyrjen n\u00eb fuqi t\u00eb tij.<\/em><\/p>\n<p style=\"text-align: justify;\"><em>&#8211; Ky vendim \u00ebsht\u00eb p\u00ebrfundimtar dhe hyn n\u00eb fuqi 6 muaj pas botimit n\u00eb Fletoren Zyrtare.<\/em><\/p>\n<p style=\"text-align: justify;\">Ky vendim \u00ebsht\u00eb shpallur n\u00eb dat\u00ebn 08.03.2021 dhe \u00ebsht\u00eb botuar n\u00eb Fletoren Zyrtare Nr. 37, dat\u00eb 11.01.2021 dhe hyn n\u00eb fuqi n\u00eb dat\u00ebn 12.07.2021.<\/p>\n<p style=\"text-align: justify;\">Gjykata Kushtetuese ka marr\u00eb n\u00eb shyqrtim \u00e7\u00ebshtjen e m\u00ebsip\u00ebrme me k\u00ebrkues <em>Shoqat\u00ebn Komb\u00ebtare \u201cPron\u00ebsi me Drejt\u00ebsi\u201d<\/em> me pretendimin se dispozita t\u00eb caktuara t\u00eb ligjit nr. 133\/2015 dhe disa akteve n\u00ebnligjore n\u00eb zbatim t\u00eb tij bien ndesh me parimet dhe standartet kushtetuese dhe ato t\u00eb KEDNJ-s\u00eb. Sipas k\u00ebrkuesit dispozitat e kund\u00ebrshtuara c\u00ebnojn\u00eb parimin e proporcionalitetit t\u00eb nd\u00ebrhyrjes n\u00eb t\u00eb drejt\u00ebn e pron\u00ebs private,\u00a0 pasi n\u00eb parashikimet e nenit 6 dhe 7, kemi t\u00eb b\u00ebjm\u00eb me konceptin e nj\u00eb \u201cshpron\u00ebsimi t\u00eb ri\u201d.<\/p>\n<p style=\"text-align: justify;\">Gjykata ka vler\u00ebsuar dhe interpretuar shp\u00ebrblimin e drejt\u00eb lidhur me konceptet kushtetuese q\u00eb kan\u00eb t\u00eb b\u00ebjn\u00eb me interesin publik, si dhe respektimin e parimeve t\u00eb drejt\u00ebsis\u00eb, t\u00eb proporcionalitetit dhe t\u00eb shtetit social. N\u00eb kuptim t\u00eb k\u00ebtyre standarteve, Gjykata ka vler\u00ebsuar se metodologjia dhe formula e parashikuar nga ligji nr. 133\/2015 nd\u00ebrhyjn\u00eb n\u00eb t\u00eb drejt\u00ebn e pron\u00ebs t\u00eb sanksionuar n\u00eb nenin 41 t\u00eb Kushtetut\u00ebs, dhe sjell nj\u00eb mas\u00eb m\u00eb t\u00eb ul\u00ebt kompensimi p\u00ebr subjektet e shpron\u00ebsuara, e cila konsiderohet si nj\u00eb \u201c<em>nd\u00ebrhyrje tjet\u00ebr<\/em>\u201d n\u00eb t\u00eb drejt\u00ebn e pron\u00ebs private.<\/p>\n<p style=\"text-align: justify;\">N\u00eb k\u00ebt\u00eb drejtim, Gjykata \u00e7mon se kjo mas\u00eb kompensimi duhet t\u00eb respektoj\u00eb nj\u00eb nivel t\u00eb caktuar, me q\u00ebllim q\u00eb t\u00eb mos \u00e7oj\u00eb n\u00eb mohimin e s\u00eb drejt\u00ebs s\u00eb pron\u00ebs private dhe t\u00eb jet\u00eb n\u00eb p\u00ebrputhje me kriteret e nd\u00ebrhyrjes n\u00eb kuptim t\u00eb neneve 41 dhe 17 t\u00eb Kushtetut\u00ebs.
