Krijim i Zon\u00ebs Shengen \u00ebsht\u00eb nj\u00ebra nga arritjet m\u00eb t\u00eb m\u00ebdha t\u00eb BE-s\u00eb, dhe \u00ebsht\u00eb akt i pakthyesh\u00ebm.<\/p>\n<p style=\"text-align: justify;\">Aktualisht, zona Schengen p\u00ebrb\u00ebhet nga 26 vende evropiane, nga t\u00eb cilat 22 jan\u00eb shtete t\u00eb BE-s\u00eb: Belgjika, Republika Ceke, Danimarka, Gjermania, Estonia, Greqia, Spanja, Franca, Italia, Letonia, Lituania, Luksemburgu, Hungaria, Malta, Holanda, Austria, Polonia, Portugalia, Sllovenia, Sllovakia, Finlanda, Suedia dhe 4 shtete joan\u00ebtare t\u00eb BE-s\u00eb, an\u00ebtare t\u00eb EFTA si an\u00ebtar\u00eb t\u00eb asociuar t\u00eb zon\u00ebs Schengen q\u00eb jan\u00eb pjes\u00eb e zon\u00ebs Schengen si Islanda, Lihtenshtajni, Norvegjia dhe Zvicra. Ka 6 an\u00ebtar\u00eb t\u00eb tjer\u00eb t\u00eb BE-s\u00eb, t\u00eb cil\u00ebt nuk i jan\u00eb bashkuar zon\u00ebs s\u00eb Schengenit: Irlanda dhe Mbret\u00ebria e Bashkuar &#8211; si dhe Rumania, Bullgaria, Kroacia dhe Qipro &#8211; q\u00eb k\u00ebrkohen dhe po k\u00ebrkojn\u00eb t\u00eb bashkohen s\u00eb shpejti. Shtetet e vogla evropiane si Monaco, San Marino dhe Vatikani jan\u00eb <em>defacto<\/em> pjes\u00eb e zon\u00ebs Schengen.<\/p>\n<p style=\"text-align: justify;\">T\u00eb q\u00ebnit pjes\u00eb e zon\u00ebs pa kontrolle n\u00eb kufijt\u00eb e brendsh\u00ebm n\u00ebnkupton q\u00eb k\u00ebto vende:<\/p>\n<ul style=\"text-align: justify;\">\n<li>Nuk kryejn\u00eb kontrolle n\u00eb kufijt\u00eb e brendsh\u00ebm (p\u00ebrkat\u00ebsisht kufijt\u00eb nd\u00ebrmjet dy shteteve an\u00ebtare t\u00eb zon\u00ebs Schengen);<\/li>\n<li>Kryejn\u00eb kontrolle t\u00eb harmonizuara, bazuar n\u00eb kriteret e p\u00ebrcaktuara qart\u00eb, n\u00eb kufijt\u00eb e tyre t\u00eb jasht\u00ebm (p\u00ebrkat\u00ebsisht kufijt\u00eb nd\u00ebrmjet nj\u00eb shteti q\u00eb \u00ebsht\u00eb an\u00ebtar i zon\u00ebs Schengen dhe nj\u00eb shtet q\u00eb nuk \u00ebsht\u00eb an\u00ebtar i zon\u00ebs Schengen).<\/li>\n<\/ul>\n<p style=\"text-align: justify;\">Bullgaria, Kroacia, Qipro, Irlanda, Rumania dhe Mbret\u00ebria e Bashkuar jan\u00eb shtete t\u00eb Bashkimit Evropian q\u00eb nuk jan\u00eb ende an\u00ebtar\u00eb t\u00eb zon\u00ebs Schengen. P\u00ebr k\u00ebt\u00eb shkak, nj\u00eb fluturim nga nj\u00ebri nga k\u00ebto shtete n\u00eb nj\u00eb shtet tjet\u00ebr q\u00eb \u00ebsht\u00eb an\u00ebtar i zon\u00ebs Schengen konsiderohet fluturim i jasht\u00ebm dhe i n\u00ebnshtrohet kontrolleve kufitare. Megjithat\u00eb, qytetar\u00ebt e BE-s\u00eb, kan\u00eb t\u00eb drejt\u00eb t\u00eb l\u00ebvizin lirsh\u00ebm gjat\u00eb udh\u00ebtimit brenda BE-s\u00eb, pavar\u00ebsisht n\u00ebse vendi \u00ebsht\u00eb an\u00ebtar i zon\u00ebs Schengen apo jo. N\u00eb parim, gjat\u00eb hyrjes n\u00eb nj\u00eb shtet t\u00eb BE-s\u00eb, i cili nuk \u00ebsht\u00eb an\u00ebtar i zon\u00ebs Schengen, qytetar\u00ebt e BE-s\u00eb, i n\u00ebnshtrohen vet\u00ebm kontrolleve minimale p\u00ebr t\u00eb verifikuar identitetet e tyre n\u00eb baz\u00eb t\u00eb dokumentave t\u00eb udh\u00ebtimit ( pasaport\u00ebs apo let\u00ebrnjoftimit).<\/p>\n<p style=\"text-align: justify;\"><strong>Sistemi i Informimit i Schengen-it<\/strong><\/p>\n<p style=\"text-align: justify;\">Sistemi i Informimit i Schengen-it (SIS), \u00ebsht\u00eb krijuar p\u00ebr t\u00eb ndihmuar n\u00eb ruajtjen e siguris\u00eb s\u00eb brendshme brenda shteteve q\u00eb jan\u00eb an\u00ebtare t\u00eb zon\u00ebs Schengen p\u00ebr munges\u00eb t\u00eb kontrolleve n\u00eb kufijt\u00eb e brendsh\u00ebm. \u00cbsht\u00eb nj\u00eb sistem i madh i informimit q\u00eb u mund\u00ebson autoriteteve policore, t\u00eb migracionit, gjyq\u00ebsore dhe autoriteteve t\u00eb tjera q\u00eb t\u2019i fusin t\u00eb dh\u00ebnat dhe t\u00eb konsultohen n\u00eb lidhje me paralajm\u00ebrimet p\u00ebr personat e zhdukur, personat q\u00eb nuk jan\u00eb shtetas t\u00eb BE-s\u00eb, t\u00eb cil\u00ebve nuk u lejohet t\u00eb hyjn\u00eb apo t\u00eb q\u00ebndrojn\u00eb n\u00eb zon\u00ebn Schengen. N\u00eb k\u00ebt\u00eb m\u00ebnyr\u00eb, SIS \u00ebsht\u00eb baza e bashk\u00ebpunimit p\u00ebr zbatimin e ligjit. N\u00eb t\u00eb nj\u00ebjt\u00ebn koh\u00eb, kontribuon n\u00eb mas\u00eb t\u00eb madhe n\u00eb mbrojtjen e kufijve t\u00eb jasht\u00ebm t\u00eb Schengen-it.<\/p>\n<p style=\"text-align: justify;\"><strong>Levizja e lire e shqiptar\u00ebve n\u00eb vendet e zon\u00ebs Schengen.<\/strong><\/p>\n<p style=\"text-align: justify;\">Shtetasit shqiptar\u00eb mund t\u00eb udh\u00ebtojn\u00eb pa viza n\u00eb t\u00eb gjitha vendet e zon\u00ebs Schengen.<\/p>\n<p style=\"text-align: justify;\">Pe\u0308rllogaritja e kohe\u0308s se\u0308 qe\u0308ndrimit te\u0308 qytetare\u0308ve shqiptare\u0308 ne\u0308 zone\u0308n Schengen.<\/p>\n<p style=\"text-align: justify;\">Qytetare\u0308t shqiptare\u0308 me pasaporte\u0308 biometrike mund te\u0308 qe\u0308ndrojne\u0308 ne\u0308 zone\u0308n Schengen, maksimumi 90 dite\u0308 qe\u0308 nga dita e hyrjes, brenda nje\u0308 periudhe\u0308 kohore prej gjashte\u0308 muaj (180 dite\u0308).<\/p>\n<p style=\"text-align: justify;\"><strong>Si pe\u0308rllogariten periudhat gjashte\u0308mujore te\u0308 le\u0308vizjes ne\u0308 hape\u0308sire\u0308n Schengen<\/strong>?<\/p>\n<p style=\"text-align: justify;\">Nume\u0308rimi i dite\u0308ve te\u0308 qe\u0308ndrimit fillon qe\u0308 nga momenti kur hyhet pe\u0308r here\u0308 te\u0308 pare\u0308 ne\u0308 zone\u0308n Schengen. Periudha gjashte\u0308mujore qe\u0308 llogaritet pe\u0308r nume\u0308rimin e 90 dite\u0308ve nuk e\u0308shte\u0308 nje\u0308 periudhe\u0308 kalendarike. Ke\u0308shtu ne\u0308se hyhet pe\u0308r here\u0308 te\u0308 pare\u0308 ne\u0308 hape\u0308sire\u0308n Schengen me\u0308 5 dhjetor, periudha gjashte\u0308mujore mbaron me\u0308 5 qershor te\u0308 vitit te\u0308 ardhshe\u0308m.<\/p>\n<p style=\"text-align: justify;\">Ne\u0308se nje\u0308 shtetas udhe\u0308ton disa here\u0308 ne\u0308 hape\u0308sire\u0308n Schengen dhe brenda nje\u0308 gjashte\u0308mujori qe\u0308ndron gjithsej 45 dite\u0308, kjo nuk do te\u0308 thote\u0308 se 45 dite\u0308t e tjera qe\u0308 nuk u shfryte\u0308zuan, te\u0308 transferohen pe\u0308r llogari te\u0308 gjashte\u0308mujorit tjete\u0308r.<\/p>\n<p style=\"text-align: justify;\">Ne\u0308se, pe\u0308r arsye te\u0308 ndryshme be\u0308hen disa udhe\u0308time afatshkurtra ne\u0308 zone\u0308n Schengen, e\u0308shte\u0308 kusht qe\u0308 kohe\u0308zgjatja e gjithe\u0308 udhe\u0308timeve te\u0308 mos kaloje\u0308 90 dite\u0308t brenda periudhe\u0308s gjashte\u0308 mujore (180 dite\u0308).<\/p>\n<p style=\"text-align: justify;\">Mosrespektimi i dite\u0308ve te\u0308 qe\u0308ndrimit (90 dite\u0308), pe\u0308rbe\u0308n shkelje te\u0308 legjislacionit te\u0308 Schengenit dhe policite\u0308 kufitare te\u0308 ke\u0308saj zone aplikon penalizime qe\u0308 arrijne\u0308 ne\u0308 gjoba deri ne\u0308 600 euro pe\u0308r person. Kjo gjobe\u0308 e\u0308shte\u0308 e detyrueshme te\u0308 paguhet brenda nje\u0308 afati te\u0308 caktuar mbasi ne\u0308 te\u0308 kunde\u0308rt, aplikohen penalizime te\u0308 tjera si ndalim hyrje pe\u0308r 5-10 vjet.<\/p>\n<p style=\"text-align: justify;\"><strong>A mund te\u0308 shfryte\u0308zohet le\u0308vizja e lire\u0308 ne\u0308 hape\u0308sire\u0308n Schengen pe\u0308r te\u0308 jetuar dhe punuar? <\/strong><\/p>\n<p style=\"text-align: justify;\">Le\u0308vizje e lire\u0308 ne\u0308 hape\u0308sire\u0308n Schengen nuk u jep te\u0308 drejte\u0308n qytetare\u0308ve shqiptare\u0308 pe\u0308r te\u0308 qe\u0308ndruar me\u0308 shume\u0308 se 3 muaj dhe as te\u0308 drejte\u0308n pe\u0308r t\u2019u pune\u0308suar, apo pe\u0308r te\u0308 ke\u0308rkuar azil, ne\u0308 ke\u0308to shtete. Ata shtetas qe\u0308 kane\u0308 nde\u0308rmend te\u0308 pune\u0308sohen apo te\u0308 studiojne\u0308 pe\u0308r nje\u0308 periudhe\u0308 qe\u0308 tejkalon 90 dite\u0308t, me\u0308 pare\u0308 duhet te\u0308 aplikojne\u0308 pe\u0308r vize\u0308 afatgjate\u0308 ose pe\u0308r leje qe\u0308ndrimi, prane\u0308 ambasade\u0308s apo konsullate\u0308s se\u0308 shtetit ku de\u0308shirojne\u0308 te\u0308 shkojne\u0308.<\/p>\n<p style=\"text-align: justify;\"><strong>Ke\u0308rkesat ndaj shtetasve shqiptare\u0308 pe\u0308r te\u0308 udhe\u0308tuar lirisht drejt te\u0308 hapsire\u0308s Schengen <\/strong><\/p>\n<ol style=\"text-align: justify;\">\n<li>a) Te\u0308 jete\u0308 i pajisur me pasaporte\u0308 biometrike.<br \/>\nb) Te\u0308 deklaroje\u0308 qe\u0308llimin e udhe\u0308timit si dhe te\u0308 paraqese\u0308, para punonje\u0308sit te\u0308 kontrollit kufitar, dokumentet qe\u0308 justifikojne\u0308 qe\u0308llimin dhe kushtet e qe\u0308ndrimit.<\/li>\n<\/ol>\n<p style=\"text-align: justify;\">-Kur deklarohet ne\u0308 kufi se po udhe\u0308tohet pe\u0308r turize\u0308m, pe\u0308r pushime, i pavarur nga pritja apo shoqe\u0308rimi i nje\u0308 personi tjete\u0308r, shtetas apo rezident ne\u0308 ate\u0308 vend etj., duhet te\u0308 paraqitet nje\u0308 rezervim hoteli, bileta e kthimit (ne\u0308se udhe\u0308tohet me avion ose mjete te\u0308 transportit ujor) si dhe te\u0308 ardhurat financiare qe\u0308 ka ai me vete.<\/p>\n<p style=\"text-align: justify;\">-Kur deklarohet se udhe\u0308tohet pe\u0308r aktivitete te\u0308 ndryshme, paraqitet dokumentacioni mbi aktivitetin, pe\u0308r te\u0308 cilin personi e\u0308shte\u0308 ftuar.<\/p>\n<p style=\"text-align: justify;\">-Kur deklarohet se udhe\u0308tohet pe\u0308r arsye she\u0308ndete\u0308sore, paraqitet rekomandimi i institucionit she\u0308ndete\u0308sor shqiptar si dhe konfirmimi i institucionit she\u0308ndete\u0308sor ku do shkohet.<\/p>\n<p style=\"text-align: justify;\">-Kur deklarohet se udhe\u0308tohet pe\u0308r vizite\u0308 tek nje\u0308 i afe\u0308rm, duhet te\u0308 jepet informacion mbi te\u0308 dhe\u0308nat e personit prite\u0308s, adresa e tij, nr. telefoni, etj. Ka vende ku si dokument binde\u0308s pe\u0308r autoritetet e kufirit e\u0308shte\u0308 edhe nje\u0308 ftese\u0308 nga familja prite\u0308se e cila mund te\u0308 jete\u0308 e firmosur nga autoritetet komunale. Kjo ke\u0308rkohet kryesisht ne\u0308 ato raste kur vizitori paraqet dyshime pe\u0308r qe\u0308llimin e udhe\u0308timit.<\/p>\n<p style=\"text-align: justify;\">Ne\u0308 te\u0308 gjitha rastet, shtetasi duhet te\u0308 kete\u0308:<br \/>\n-siguracionin she\u0308ndete\u0308sor (pe\u0308r periudhe\u0308n e qe\u0308ndrimit)<br \/>\n-dokumentacionin e nevojshe\u0308m te\u0308 makine\u0308s, ne\u0308se udhe\u0308tohet me makine\u0308 (leje nde\u0308rkombe\u0308tare drejtimi automjeti, patente\u0308 nde\u0308rkombe\u0308tare dhe karton te\u0308 gjelbe\u0308rt sigurimi nde\u0308rkombe\u0308tar te\u0308 makine\u0308s).<br \/>\n-Mjetet e udhe\u0308timit (bileta avioni, trageti,etj.)<br \/>\n-Mjetet e jetese\u0308s gjate\u0308 qe\u0308ndrimit ne\u0308 zone\u0308n Schengen<\/p>\n<p style=\"text-align: justify;\">Shtetasi duhet te\u0308 kete\u0308 mjete te\u0308 mjaftueshme te\u0308 jetese\u0308s, si pe\u0308r periudhe\u0308n e qe\u0308ndrimit te\u0308 synuar edhe pe\u0308r kthimin ne\u0308 vendin e prejardhjes ose transitin ne\u0308 nje\u0308 shtet te\u0308 trete\u0308 ne\u0308 te\u0308 cilin ai e\u0308shte\u0308 i sigurt se do te\u0308 pranohet, apo e\u0308shte\u0308 ne\u0308 gjendje te\u0308 pe\u0308rfitoje\u0308 mjete te\u0308 tilla ne\u0308 me\u0308nyre\u0308 te\u0308 ligjshme. Po sa e\u0308shte\u0308 kjo shume\u0308? Vende te\u0308 ndryshme kane\u0308 pe\u0308rcaktuar shuma te\u0308 ndryshme. Pe\u0308rafe\u0308rsisht kjo shume\u0308 nuk e kalon 50 euro dita, kur shtetasi ka nje\u0308 rezervim hoteli.<\/p>\n<ol style=\"text-align: justify;\">\n<li>c) Shtetasi nuk duhet te\u0308 figuroje\u0308 ne\u0308 listat e personave qe\u0308 pe\u0308rbe\u0308jne\u0308 ke\u0308rce\u0308nim pe\u0308r rendin, she\u0308ndetin publik apo sigurine\u0308 e brendshme.<\/li>\n<li>d) Emri i ke\u0308tij shtetasi nuk duhet te\u0308 figuroje\u0308 nde\u0308r emrat e personave ndaj te\u0308 cile\u0308ve e\u0308shte\u0308 dhe\u0308ne\u0308 masa ndalim hyrje qofte\u0308 edhe ne\u0308 nje\u0308 nga vendet ne\u0308 fjale\u0308.<\/li>\n<\/ol>\n<p style=\"text-align: justify;\">Ne\u0308se pe\u0308r c\u0327do nje\u0308rin shtetas e\u0308shte\u0308 marre\u0308 nje\u0308 vendim nga autoritetet administrative kufitare apo ato gjyqe\u0308sore te\u0308 qofte\u0308 edhe nje\u0308rit nga vendet e hape\u0308sire\u0308s Schengen pe\u0308r t\u2019i ndaluar hyrjen ne\u0308 ate\u0308 vend, dhe ky informacion e\u0308shte\u0308 hedhur ne\u0308 sistemin SIS, ky person nuk mundet dhe nuk do lejohet te\u0308 hyje\u0308 ne\u0308 asnje\u0308 nga ke\u0308to vende; pra do te\u0308 prape\u0308sohet, me te\u0308 mbe\u0308rritur ne\u0308 pike\u0308n e kalimit te\u0308 kufirit te\u0308 vendit te\u0308 pare\u0308 te\u0308 hape\u0308sire\u0308s Schengen. Vendimet pe\u0308r te\u0308 ndaluar hyrjen, jane\u0308 kompetence\u0308 e ke\u0308tyre autoriteteve. Ke\u0308to vendime merren pe\u0308r raste, te\u0308 cilat i ka pe\u0308rcaktuar Kodi Schengen, dhe jane\u0308:<\/p>\n<p style=\"text-align: justify;\">-kur personi e\u0308shte\u0308 de\u0308nuar pe\u0308r nje\u0308 vepe\u0308r penale pe\u0308r te\u0308 cile\u0308n Kodi Penal parashikon de\u0308nim minimal 1 vit burg.<\/p>\n<p style=\"text-align: justify;\">-kur personi ka qene\u0308 subjekt i nje\u0308 urdhe\u0308r largimi, largimi me force\u0308 (deportimi, kthimi apo de\u0308bimi), qe\u0308 kryesisht zbatohen pe\u0308r raste te\u0308 qe\u0308ndrimit te\u0308 paligjshe\u0308m.<\/p>\n<p style=\"text-align: justify;\">-kur ka te\u0308 dhe\u0308na se personi e\u0308shte\u0308 pe\u0308rfshire\u0308 ne\u0308 aktivitete kriminale apo de\u0308shmi te\u0308 qarta se ka pe\u0308r qe\u0308llim nje\u0308 gje\u0308 te\u0308 tille\u0308.<\/p>\n<p style=\"text-align: justify;\">Vendimet te\u0308 tilla, ne\u0308 te\u0308 gjitha rastet u komunikohen me shkrim te\u0308 interesuarve. Dhe kjo mase\u0308 nuk hiqet automatikisht me mbarimin e ke\u0308saj periudhe. Kurdohere\u0308, kur shtetasit e mbyllin ke\u0308te\u0308 periudhe\u0308 penalizimi disa vjetore, duhet qe\u0308 mbi baze\u0308n e vendimit te\u0308 dhe\u0308ne\u0308 dhe me ndihme\u0308n e nje\u0308 avokati, t\u2019u ke\u0308rkoje\u0308 autoriteteve te\u0308 shtetit pe\u0308rkate\u0308s heqjen nga sistemi SIS te\u0308 mase\u0308s se\u0308 ndalimit.<\/p>\n<p style=\"text-align: justify;\">Ne\u0308 raste te\u0308 vec\u0327anta, kur konstatohen zvarritje administrative dhe dokumentacioni i shtetasit e\u0308shte\u0308 i rregullt, MPJ ne\u0308pe\u0308rmjet pe\u0308rfaqe\u0308sise\u0308 diplomatike mund te\u0308 ke\u0308rkoje\u0308 informacion prane\u0308 autoriteteve kompetente te\u0308 vendit pe\u0308rkate\u0308s, me qe\u0308llim sqarimin dhe lehte\u0308simin e situate\u0308s se\u0308 shtetasve shqiptare\u0308.<\/p>\n<ol style=\"text-align: justify;\">\n<li>e) Pe\u0308r minorene\u0308t, ne\u0308se nuk jane\u0308 te\u0308 shoqe\u0308ruar nga te\u0308 dy prinde\u0308rit, ke\u0308rkohet te\u0308 respektohen kushtet e le\u0308vizjes sipas legjislacionit kombe\u0308tar dhe nde\u0308rkombe\u0308tar.<\/li>\n<\/ol>\n<p style=\"text-align: justify;\"><strong>C\u0327fare\u0308 ndodh ne\u0308se qytetare\u0308t shqiptare\u0308 shkelin rregullat e qe\u0308ndrimit ?<\/strong><\/p>\n<p style=\"text-align: justify;\">Ne\u0308 hyrje dhe gjate\u0308 qe\u0308ndrimit ne\u0308 vendet e BE-se\u0308, qytetare\u0308t shqiptare\u0308 duhet qe\u0308 te\u0308 zbatojne\u0308 disa ke\u0308rkesa dhe rregulla. Ne\u0308se do t\u2019i shkelin ke\u0308to rregulla, ata do te\u0308 be\u0308hen subjekt i largimit apo deportimit me force\u0308, veprim i cili shoqe\u0308rohet gjithmone\u0308 me ndalim hyrje nga 1-5 vjet.<\/p>\n<p style=\"text-align: justify;\">Pe\u0308r nje\u0308 kategori shkeljesh te\u0308 rregullave te\u0308 qe\u0308ndrimit, shtetet ane\u0308tare\u0308 te\u0308 BE-se\u0308 aplikojne\u0308 masa administrative gjobe, te\u0308 cilat shkojne\u0308 nga 600 deri ne\u0308 3000 euro. Ne\u0308 rast se ke\u0308to shuma nuk paguhen, ate\u0308here\u0308 personi i gjobitur nuk do lejohet te\u0308 hyje\u0308 ne\u0308 ate\u0308 vend, qe\u0308 i ka vendosur gjobe\u0308n, deri sa ta paguaje\u0308 ate\u0308 me gjithe\u0308 kamate\u0308n e vonese\u0308s.<\/p>\n<p style=\"text-align: justify;\">Me re\u0308nde\u0308si e\u0308shte\u0308 te\u0308 dihet se cilat jane\u0308 ke\u0308to rregulla qe\u0308 shtetasit shqiptare\u0308 nuk duhet te\u0308 shkelin:<\/p>\n<p style=\"text-align: justify;\">-Se\u0308 pari, nuk duhet te\u0308 shkelet afati i lejuar pe\u0308r qe\u0308ndrim qe\u0308 e\u0308shte\u0308 90 dite\u0308 brenda 180 dite\u0308ve.<\/p>\n<p style=\"text-align: justify;\">-Se\u0308 dyti, nuk duhet te\u0308 shkelet legjislacioni vendas, kryesisht ai mbi pune\u0308simin.<br \/>\nPra, ne\u0308se kapesh duke punuar pa dokumentacion te rregullt be\u0308hesh subjekt i largimit dhe ndalimit te\u0308 hyrjes.<\/p>\n<p style=\"text-align: justify;\">-Se\u0308 treti, nuk duhet te\u0308 be\u0308hesh problem pe\u0308r sigurine\u0308 publike, apo te\u0308 pe\u0308rfshihesh ne\u0308 aktivitete kriminale.<\/p>\n<p style=\"text-align: justify;\">-Se\u0308 kate\u0308rti, nuk duhet te\u0308 be\u0308hesh barre\u0308 publike (person qe\u0308 nuk ke te\u0308 siguruar strehimin, ushqimin apo nevojat e tjera jete\u0308sore).<\/p>\n<p style=\"text-align: justify;\">Te\u0308 gjitha ke\u0308rkesat qe\u0308 pe\u0308rmenden me\u0308 lart mbi hyrjen dhe qe\u0308ndrimin ne\u0308 zone\u0308n Schengen jane\u0308 kushte qe\u0308 aplikohen pe\u0308r te\u0308 gjithe\u0308 te\u0308 huajt ne\u0308 BE.<\/p>\n<p style=\"text-align: justify;\"><strong>Shkelja e rregullave, Espulsi<\/strong><\/p>\n<p style=\"text-align: justify;\">Espuls do t\u00eb thot\u00eb largimin e detyruar t\u00eb p\u00ebrsonit q\u00eb ndodhet n\u00eb territorin\u00a0 e atij shteti n\u00eb m\u00ebnyr\u00eb t\u00eb pa ligjshme.<\/p>\n<p style=\"text-align: justify;\">Espulsi vendoset nga gjyqtari p\u00ebrgjegj\u00ebs q\u00eb vendos me dekretin e motivuar mbasi ka marr\u00eb nga organet e policis\u00eb informacionet n\u00eb lidhje me identitetin dhe komb\u00ebsin\u00eb e t\u00eb huajit. Dekreti i komunikohet personit i cili, brenda dhjet\u00eb dit\u00ebve, mund t\u00eb paraqes\u00eb ankes\u00eb n\u00eb Gjykat\u00ebn\u00a0 Mbik\u00ebqyr\u00ebse ( t\u00eb ekzekutimeve t\u00eb d\u00ebnimeve penale). N\u00ebse i huaji nuk \u00ebsht\u00eb i asistuar nga nj\u00eb avokat mbrojt\u00ebs, gjyqtari em\u00ebron nj\u00eb mbrojt\u00ebs publik. Gjykata vendos brenda 20 dit\u00ebve.<\/p>\n<p style=\"text-align: justify;\"><strong>Espulsi \u00ebsht\u00eb dy llojesh:<\/strong><\/p>\n<ol style=\"text-align: justify;\">\n<li>Espuls administrativ<\/li>\n<li>Espuls gjyq\u00ebsor<\/li>\n<\/ol>\n<p style=\"text-align: justify;\">Espulsi administrativ zakonisht vendoset n\u00eb rastet kur personi \u00a0ka kaluar afatin 90 ditor, i cili p\u00ebrcaktohet ne CE<a href=\"#_ftn1\" name=\"_ftnref1\">[1]<\/a> dhe n\u00eb Traktatin e BE<a href=\"#_ftn2\" name=\"_ftnref2\">[2]<\/a> .<\/p>\n<p style=\"text-align: justify;\">Dhe n\u00ebse ndodhemi n\u00eb m\u00ebnyr\u00eb t\u00eb paligjshme brenda atij territori q\u00eb do t\u00eb thot\u00eb n\u00eb munges\u00eb t\u00eb nj\u00eb dokumentacioni, at\u00ebher jemi n\u00eb rastin e marrjes s\u00eb ESPULSIT.<\/p>\n<p style=\"text-align: justify;\">D\u00ebnimi p\u00ebr sa i p\u00ebrket espulsit administrativ, n\u00ebse kemi shkelje afati, d\u00ebnohet me gjob\u00eb kjo ne varesi te ligjit dhe p\u00ebrsonit i cili i \u00ebsht\u00eb lejuar q\u00eb t\u00eb vendos\u00eb k\u00ebt\u00eb lloj d\u00ebnimi.<\/p>\n<p style=\"text-align: justify;\">Nd\u00ebrsa n\u00eb rastin e munges\u00ebs s\u00eb dokumentacionit espulsi jepet me d\u00ebbim nga territori dhe zgjat maksimumi 5 vite pa t\u00eb drejt\u00eb shkelje n\u00eb at\u00eb shtet dhe n\u00ebse \u00ebsht\u00eb pjes\u00eb e shengenit ai duhet t\u00eb marr\u00eb masa p\u00ebr nisjen e nj\u00eb procedure, pasi ai nuk mund t\u00eb shkel\u00eb n\u00eb asnj\u00eb nga shtetet e Zon\u00ebs s\u00eb Shengenit.<\/p>\n<p style=\"text-align: justify;\">P\u00ebr sa i p\u00ebrket Espulsit Gjyq\u00ebsor, kjo ndodh n\u00eb ato raste kur p\u00ebrsoni \u00ebsht\u00eb d\u00ebnuar p\u00ebr nj\u00eb vep\u00ebr penale dhe ka kryer d\u00ebnimin me burg n\u00eb at\u00eb shtet, p\u00ebrpos k\u00ebsaj KE<a href=\"#_ftn3\" name=\"_ftnref3\">[3]<\/a> n\u00ebp\u00ebrmjet ligjeve, ia lejon shtetit n\u00eb t\u00eb cil\u00ebn ka kryer burgimin q\u00eb p\u00ebr t\u00eb, t\u00eb japin mas\u00eb d\u00ebbimi \u201cEspuls\u201d. Kjo ndodh n\u00eb ato raste kur personi ka vepruar n\u00eb kund\u00ebrshtim me ligjin e atij shteti q\u00eb \u00ebsht\u00eb kapur dhe q\u00eb ka marr\u00eb d\u00ebnimin p\u00ebr burgosje. N\u00eb k\u00ebt\u00eb rast ne kemi nje tjeter ndryshim nd\u00ebrmjet mas\u00ebs administrative pasi espulsi shkon deri ne 10 vite ose edhe e p\u00ebrher\u00ebshme duk\u00eb par\u00eb rrethanat r\u00ebnduese ose leht\u00ebsuese, kjo ka t\u00eb b\u00ebj\u00eb me rrethanat specifike t\u00eb rastit dhe do t\u00eb ishte e nj\u00ebjt\u00eb me rrethanat r\u00ebnduese ose leht\u00ebsuese n\u00eb procedur\u00ebn penale. K\u00ebto do t\u00eb p\u00ebrmenden n\u00eb d\u00ebnimin q\u00eb personi ka marr\u00eb.<\/p>\n<p style=\"text-align: justify;\">Ekzekutimi i dekretit mbetet i pezulluar deri n\u00eb skadimin e periudh\u00ebs s\u00eb apelit dhe vendimit t\u00eb Gjykat\u00ebs Mbikqyr\u00ebse. Pra gjendja e burgimit mbetet deri sa t\u00eb merren dokumentat e udh\u00ebtimit. Espulsi b\u00ebhet nga organi kompetent i vendit t\u00eb burgimit, i cili parashikon shoq\u00ebrimin deri n\u00eb kufi nga policia. D\u00ebnimi quhet i vuajtur me skadimin e periudh\u00ebs dhjet\u00ebvje\u00e7are nga ekzekutimi i urdhrit t\u00eb espulsit, me kusht q\u00eb i huaji nuk \u00ebsht\u00eb rikthyer n\u00eb m\u00ebnyr\u00eb t\u00eb paligjshme n\u00eb territorin e Shtetit. N\u00eb k\u00ebt\u00eb rast, riaktivizohet burgimi dhe ekzekutimi i vuajtjes s\u00eb d\u00ebnimit.<\/p>\n<p style=\"text-align: justify;\"><strong>Rruga qe ndiqet per heqjen e espulsit <\/strong><\/p>\n<p style=\"text-align: justify;\">Aplikimi duhet t\u00eb tregoj\u00eb \u00e7do rrethan\u00eb t\u00eb re q\u00eb e b\u00ebn at\u00eb t\u00eb shp\u00ebrpjestuar p\u00ebr t\u00eb mbajtur ndalimin p\u00ebr t\u00eb hyr\u00eb.<\/p>\n<p style=\"text-align: justify;\">P\u00ebrshembull n\u00ebse marrim Norvegjine si shtet ndaj te cilit ka ndodhur veprimi i paligjsh\u00ebm, nj\u00eb k\u00ebrkes\u00eb p\u00ebr anulimin e ndalimit p\u00ebr t\u00eb hyr\u00eb duhet t\u00eb d\u00ebrgohet nga ambasada norvegjeze n\u00eb vendin e origjin\u00ebs ose n\u00eb ndonj\u00eb vend tjet\u00ebr n\u00eb t\u00eb cilin personi ka juridikisht rezident. Aplikuesi duhet t\u00eb marr\u00eb pjes\u00eb personalisht n\u00eb ambasad\u00eb.<\/p>\n<p style=\"text-align: justify;\">Kjo do t\u00eb thot\u00eb q\u00eb regjistrimi n\u00eb SIS<a href=\"#_ftn4\" name=\"_ftnref4\">[4]<\/a> do t\u00eb fshihet, por personi n\u00eb fjal\u00eb ende nuk do t\u00eb jet\u00eb n\u00eb gjendje t\u00eb hyj\u00eb n\u00eb Norvegji. N\u00eb kerkese, personi q\u00eb aplikon duhet t\u00eb tregoj\u00eb se ai ose ajo ka nj\u00eb k\u00ebrkes\u00eb p\u00ebr t\u00eb udh\u00ebtuar dhe nj\u00eb lidhje me nj\u00eb shtet Shengen. Aplikimi duhet t\u00eb d\u00ebrgohet n\u00eb shtetin \/ shtetet Shengen p\u00ebr t\u00eb cilat k\u00ebrkohet anulimi i ndalimit p\u00ebr t\u00eb hyr\u00eb.<\/p>\n<p style=\"text-align: justify;\">Ndalimi i rihyrjes zgjat 10 vjet t\u00eb cilat llogariten q\u00eb nga data e zbatimit t\u00eb d\u00ebbimit, i v\u00ebrtetuar nga vula e daljes ose nga \u00e7do dokument tjet\u00ebr q\u00eb d\u00ebshmon se i huaji nuk ndodhej m\u00eb n\u00eb territorin komb\u00ebtar .<\/p>\n<p style=\"text-align: justify;\">N\u00eb baz\u00eb t\u00eb nenit 13, paragrafi 13 i testit unik num\u00ebr 287\/1998, shtetasi i huaj q\u00eb ka marr\u00eb dekret d\u00ebbimi mund t\u00eb hyj\u00eb s\u00ebrish duke k\u00ebrkuar nj\u00eb autorizim t\u00eb posa\u00e7\u00ebm rifutjeje n\u00eb territorin komb\u00ebtar.<\/p>\n<p style=\"text-align: justify;\">Mundet q\u00eb personi t\u00eb hyj\u00eb s\u00ebrish por duhet t\u00eb d\u00ebshmoj\u00eb dhe t\u00eb paraqes\u00eb t\u00eb gjitha dokumentet q\u00eb v\u00ebrtetojn\u00eb jo vet\u00ebm se ka dal\u00eb v\u00ebrtet nga territori komb\u00ebtar atij shteti, por q\u00eb p\u00ebr gjith\u00eb k\u00ebt\u00eb periudh\u00eb nuk ka hyr\u00eb n\u00eb hap\u00ebsir\u00ebn Shengen.<\/p>\n<p style=\"text-align: justify;\">Personi i autorizuar (avokati) duhet t\u00eb shkoj\u00eb personalisht n\u00eb p\u00ebrfaq\u00ebsin\u00eb Diplomatike t\u00eb shtetit dhe t\u00eb paraqes\u00eb nj\u00eb k\u00ebrkes\u00eb p\u00ebr pezullimin e d\u00ebbimit, adresuar Ministris\u00eb s\u00eb Brendshme.<\/p>\n<p>P\u00ebrfaq\u00ebsia diplomatike s\u00eb pari do t\u00eb verifikoj\u00eb identitetin e tij dhe do t\u00eb shqyrtoj\u00eb t\u00eb gjitha dokumentet q\u00eb duhet t\u00eb jen\u00eb sa m\u00eb t\u00eb detajuara dhe duhet t\u00eb d\u00ebshmojn\u00eb q\u00ebndrimin e personit jasht\u00eb Shengenit p\u00ebr t\u00eb gjith\u00eb periudh\u00ebn e parashikuar nga dekreti i d\u00ebbimit.<\/p>\n<p style=\"text-align: justify;\">P\u00ebrfaq\u00ebsia diplomatike i d\u00ebrgon gjith\u00eb dokumentet Ministris\u00eb e cila do t\u00eb vler\u00ebsoj\u00eb dhe do t\u00eb verifikoj\u00eb respektimin e kushteve p\u00ebr t\u00eb rihyr\u00eb n\u00eb at\u00eb shtet p\u00ebr t\u00eb cilin kan\u00eb nisur k\u00ebto procedura dhe b\u00ebn p\u00ebrdit\u00ebsimin e arkivit s\u00eb policis\u00eb s\u00eb zon\u00ebs Shengen.<\/p>\n<p style=\"text-align: justify;\">P\u00ebrfaq\u00ebsia diplomatike e shtetit q\u00eb ka konsoliduar shkeljen, do t\u2019i jap\u00eb p\u00ebrgjigje t\u00eb autorizuarit p\u00ebr vendimin q\u00eb do t\u00eb marr\u00eb Ministria e Brendshme.<\/p>\n<p style=\"text-align: justify;\">Kujtojm\u00eb se i huaji i d\u00ebbuar mund t\u00eb rihyj\u00eb n\u00eb shetin qe ka pasur probleme, edhe p\u00ebrpara se t\u00eb ket\u00eb marr\u00eb fund periudha e ndalimit t\u00eb ardhjes, p.sh. kur gjen nj\u00eb pun\u00ebdh\u00ebn\u00ebs q\u00eb \u00ebsht\u00eb i gatsh\u00ebm ta marr\u00eb n\u00eb pun\u00eb. Duhet gjithsesi t\u00eb paraqes\u00eb nj\u00eb k\u00ebrkes\u00eb p\u00ebr t\u00eb marr\u00eb nj\u00eb autorizim t\u00eb posa\u00e7\u00ebm nga Ministria e Brendshme q\u00eb t\u00eb hyj\u00eb m\u00eb par\u00eb se afati i parashikuar nga dekreti i d\u00ebbimit.Edhe n\u00eb k\u00ebt\u00eb rast i huaji q\u00eb ka marr\u00eb d\u00ebbimin, duhet t\u00eb paraqes\u00eb k\u00ebrkes\u00eb pran\u00eb p\u00ebrfaq\u00ebsis\u00eb diplomatike e cila ia p\u00ebrcjell Ministris\u00eb s\u00eb Brendshme<\/p>\n<p style=\"text-align: justify;\">N\u00ebse ndaj personit ka kaluar afati kohor 5-vjecar at\u00ebher kjo do t\u00eb thot\u00eb se ndaj tij \u00ebsht\u00eb hequr masa e debimit por n\u00eb t\u00eb v\u00ebrtet nuk \u00ebsht\u00eb k\u00ebshtu, p\u00ebrvec kesaj, p\u00ebrsoni duhet q\u00eb n\u00eb k\u00ebt\u00eb hark kohor t\u00eb mos ket\u00eb b\u00ebr\u00eb shkelje n\u00eb at\u00eb shtet por as edhe n\u00eb shtet te cilat jan\u00eb n\u00eb Zon\u00ebn Shengen. P\u00ebrs\u00ebri heqja e emrit duhet t\u00eb b\u00ebhet n\u00ebp\u00ebrmjet k\u00ebrkes\u00ebs q\u00eb niset nga personi q\u00eb k\u00ebrkon k\u00ebt\u00eb t\u00eb drejt\u00eb, duke autorizuar personin q\u00eb ka njohurit\u00eb dhe q\u00eb \u00ebsht\u00eb kompetent p\u00ebr t\u00eb v\u00ebn\u00eb n\u00eb l\u00ebvizje organtet tjera kompetente.<\/p>\n<p style=\"text-align: justify;\">Gjithashtu personi i cili nuk d\u00ebshiron q\u00eb t\u00eb pres\u00eb k\u00ebt\u00eb hark kohor, ai mund t\u00eb l\u00eb t\u00eb kaloje 2\/3 e koh\u00ebs dhe t\u00eb paraqes\u00eb\u00a0 k\u00ebrkes\u00ebn e tij p\u00ebr fshirjen e\u00a0 emrit nga kjo list\u00eb SIS<a href=\"#_ftn5\" name=\"_ftnref5\">[5]<\/a>. Procedrura ndiqet nga avokati i pal\u00ebs kerkuese drejtuar Ministris\u00eb ose P\u00ebrfaq\u00ebsive Diplomatike.<\/p>\n<p style=\"text-align: justify;\">K\u00ebt\u00eb t\u00eb drejt\u00eb e njeh edhe legjislacioni shqiptar, ku n\u00eb nenin 13 te Kodit te Procedures Civile, shprehet se: <strong><em>Faktet t<\/em><\/strong>\u00eb<strong><em> njohura Bot<\/em><\/strong>\u00eb<strong><em>risht ose zyrtarisht nuk kan<\/em><\/strong>\u00eb<strong><em> nevoj<\/em><\/strong>\u00eb<strong><em> t<\/em><\/strong>\u00eb<strong><em> provohen para nj<\/em><\/strong>\u00eb<strong><em> gjykate, Fakte, p<\/em><\/strong>\u00eb<strong><em>r t<\/em><\/strong>\u00eb<strong><em> cilat ekziston nj<\/em><\/strong>\u00eb<strong><em> prezumim ligjor.<\/em><\/strong><\/p>\n<p style=\"text-align: justify;\">Kjo do t\u00eb thot\u00eb q\u00eb duhet t\u00eb ekzistoj\u00eb nj\u00eb ekuilib\u00ebr mes arsyeve p\u00ebr d\u00ebbim dhe m\u00ebnyr\u00ebs s\u00eb largimit do t\u00eb ndikoj\u00eb tek personi q\u00eb vler\u00ebsohet p\u00ebr d\u00ebbim dhe familjen e tij t\u00eb af\u00ebrt. D\u00ebbimi duhet gjithashtu t\u00eb jet\u00eb n\u00eb kuad\u00ebr t\u00eb <strong>Konvent\u00ebs Evropiane p\u00ebr t\u00eb Drejtat e Njeriut<a href=\"#_ftn6\" name=\"_ftnref6\">[6]<\/a>, Neni 8<\/strong>.<\/p>\n<p style=\"text-align: justify;\">Procesi fillon q\u00eb me d\u00ebrgimin e letrave tek shteti q\u00eb \u00ebsht\u00eb b\u00ebr\u00eb shkelja, p\u00ebr k\u00ebt\u00eb arsyje duhet edhe vula APOSTILE dhe dokumentat t\u00eb jen\u00eb t\u00eb p\u00ebrkthyera n\u00eb gjuh\u00ebn e shtetit t\u00eb shengenit q\u00eb ka vendosur d\u00ebbimin.<\/p>\n<p style=\"text-align: justify;\">P\u00ebrvec k\u00ebsaj\u00a0 p\u00ebrsoni duhet t\u00eb ket\u00eb t\u00eb gjith\u00eb dokumentacionin q\u00eb i \u00ebsht\u00eb dh\u00ebn\u00eb n\u00eb momentin e d\u00ebbimit, pasi aty b\u00ebhet m\u00eb s\u00eb miri cil\u00ebsimi se p\u00ebr cfar\u00eb arsyeje \u00ebsht\u00eb deportuar.<\/p>\n<p style=\"text-align: justify;\">Gjithashtu duhet te p\u00ebrmendim edhe n\u00eb rast kur refuzohet k\u00ebrkesa p\u00ebr \u00a0heqjen e espulsit, mund t\u00eb ndodh\u00eb q\u00eb k\u00ebrkesa te mos pranohet.
